If any enclosing fence shall prevent passage on the sidewalk, the owner, through his agent in charge thereof, shall cause to be laid and maintained in good repair and free of rubbish, dirt and snow a temporary plank sidewalk around the same, not less than one-third the width of the sidewalk, but never less than three feet wide.
