766.07 TATTOOING DISEASED, INTOXICATED OR DRUGGED PERSONS: MINORS.
   (a)    It shall be unlawful to tattoo any person who is known to have, or who shows signs of having any communicable disease or any disease of the skin, including rashes, pimples, boils, infections of any manifestation or evidence of unhealthy conditions.
 
   (b)    It shall be unlawful to tattoo any individual under the influence of alcohol and/or narcotic drug or drug of abuse.
 
   (c)    It shall be unlawful for any tattoo operator to be under the influence of alcohol and/or narcotic drug or drug of abuse when tattooing.
 
   (d)    It shall be unlawful to tattoo any individual who is under twenty-one (21) years of age, regardless of whether the operator knows this person to be less than twenty-one (21 ) years of age, or operator is reckless in that regards.
 
   (e)    Whoever violates this section is guilty of a misdemeanor of the first degree. This Section shall be enforced by the Director of Public Safety or designee, the Division of Police, or any public health official.
