764.99 PENALTY.

   (a)    Violations of this chapter shall be misdemeanor offenses punishable by fine or imprisonment as follows:

   For a first degree misdemeanor, imprisonment of not more than six (6) months and/or a fine of not more than One Thousand Dollars ($1,000);

   For a second degree misdemeanor, imprisonment of not more than ninety (90) days and/or a fine of not more than Seven Hundred Fifty Dollars ($750);

   For a third degree misdemeanor, imprisonment of not more than sixty (60) days and/or a fine of not more than Five Hundred Dollars ($500);

   For a fourth degree misdemeanor, imprisonment of not more than thirty (30) days and/or a fine of not more than Two Hundred Fifty Dollars ($250); and,

   For a minor misdemeanor, a fine of not more than One Hundred Dollars ($100).

   (b)    Each day that a sexually oriented business or adult motel operates in violation of this chapter is a separate offense or violation.
