No person, agent, firm or corporation shall sell, by land contract or otherwise, any interest in any dwelling, building or structure, without furnishing the buyer, prior to such sale, a current certificate of occupancy or a statement from the Building Commissioner setting forth the authorized use of such dwelling under the ordinances of the city as well as an informational certificate provided for in Chapter 1337
of the Building Code, and when an escrow has been established, depositing in escrow prior to delivery of possession or transfer of title a statement from the buyer acknowledging the receipt of such documents; provided, however, that a statement signed by both the seller and buyer setting forth the fact that the property being transferred is a one-family dwelling or does not contain thereon a dwelling, building or structure may be deposited in escrow in lieu of the documents required herein.
