(a) Every shop owner, keeper, manager or businessman or his agent, who generally and in the natural course of the operation of his business supplies the public with shopping carts, shall place in a secure manner an identifying tag listing such person's business name and address on each individual shopping cart under such person's ownership or control.
(b) It shall be the duty of every shop owner, keeper, manager, businessman or his agent, who generally and in the natural course of the operation of his business supplies the public with shopping carts, to collect and store all shopping carts within his building or place of business before the close of business each day. Any shopping cart found on any public property, including streets, alleys, roadways, tree lawns, and other public areas, after the close of business each day is hereby declared to be a public nuisance and the presence of a shopping cart on public property, including streets, alleys, roadways, tree lawns, and other public areas, after the close of business each day shall constitute a prima-facie violation of this paragraph. Each shopping cart so found shall constitute a separate violation of this section.
(c) In addition to constituting a nuisance and subject to violation of law as hereinabove provided, any shopping carts found on public property, including streets, alleys, roadways, tree lawns and public areas, shall be picked up and collected by the Department of Public Safety and deposited in a place or area to be designated by the Safety Director.
(d) Any shop owner, keeper, manager or businessman or his agent, whose shipping carts are so collected and stored, may reclaim the same upon payment of the sum of ten dollars ($10.00) for each such cart so claimed.
(e) The Safety Director shall from time to time advertise the public sale or disposition of unclaimed shopping carts at least ten days before such sale is held in any newspaper sold or distributed in the City. Any unclaimed or unsold carts shall be disposed of by the Safety Director immediately after such sale is advertised and held.
(f) All proceeds realized from the collection and sale of such shopping carts shall be credited to the General Fund of the City.
(g) Any person, corporation, partnership or unincorporated association, violating the provisions of subsection (a) hereof is guilty of a minor misdemeanor and fined not less than fifty dollars ($50.00). For a subsequent offense such person is guilty of a misdemeanor of the fourth degree and fined not less than one hundred dollars ($100.00).
