542.02 CHILD-VICTIM AND SEXUALLY ORIENTED OFFENDER RESIDENCY PROHIBITION.
   (a)   It is unlawful for a child-victim or sexually oriented offender who is required to register with the County Sheriffs Department to reside within one thousand feet of any school premises or preschool or child day-care center premises.
 
   (b)   Any person who violates this provision is guilty of a misdemeanor of the second degree and shall be punished as provided in Section 501.99 of the Codified Ordinances of the City of Garfield Heights.
 
   (c)   Any person who has been previously convicted of a violation of this section and convicted of a second or subsequent offense or violation of this section is guilty of a misdemeanor of the first degree and shall be punished as provided in Section 501.99 of the Codified Ordinances of the City of Garfield Heights.
 
   (d)   Nothing in this section shall prevent the Director of Law or Prosecutor from taking action against a person convicted of a sexually oriented offense who is required to register as a sexual offender as provided in Ohio R.C. 2950.034.
