(a) Except as otherwise provided, no person, firm, corporation or partnership shall sell or distribute at the curbs of the streets of the City any merchandise, literature, food, goods or other articles.
Whenever the Mayor proclaims that a state of emergency exists in the City by reason of war, strike, insurrection, floods, fires or other disaster, the provisions of this section shall not prohibit the free distribution of food, clothing, medicines or other articles necessary for the preservation of the public health, safety or welfare.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
