(a) No person, being the owner or in charge or control of any dog, shall permit such dog to remain outdoors and in the elements overnight or for extended periods of time without having first provided suitable shelter or access to suitable shelter. "Suitable shelter" includes, but is not limited to, a doghouse, garage, enclosed porch, shed or other permitted accessory building or structure which would provide protection for the dog from the elements.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
