(a) The driver of any motor vehicle which is in any manner involved in a motor vehicle accident shall within five days make out an accident form prescribed by the Safety Director and/or Chief of Police, providing that there shall have been an injury, death or property damage exceeding one hundred dollars ($100.00).
(b) A driver involved in a motor vehicle accident is not subject to subsection (a) hereof if, during time provided therein, the driver is physically incapable of making a report, but in such event, the owner, if he were not the driver of the motor vehicle involved in the accident, shall within five days after learning of the accident make the report.
(c) The driver or owner involved in a motor vehicle traffic accident is not subject to subsection (a) hereof if the Police Division is called to the scene of the accident and a report is taken by the Police Division of the accident.
