(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(C) Any violation of any of the provisions of § 130.26 is to be declared unlawful and a Class D misdemeanor. Any person found in violation of the provisions of § 130.26 shall be punished by a fine of not less than $50 and not more than $500 plus any court costs and attorney fees that may result from prosecution. Except for cases filed for prosecution, the set fine shall be in the amount of $50 and will be payable to the Town Clerk-Treasurer no later than 14 days from the date of violation. Failure to settle the fine in a timely manner will result in the violation being filed for prosecution.
(2) In lieu of suit or prosecution, any law enforcement officer may issue a citation to the responsible person who may be found in violation of this chapter. Such citation shall impose upon the responsible person a penalty of $35 for the first offense. The penalty shall increase for a second and all subsequent offenses to $50. The penalty fee shall be collected by the Town Clerk-Treasurer and shall be due and payable two weeks from the date of the citation and shall be deposited as directed by the Town Council.
(E) Any person who violates §§ 130.50 through 130.55 shall be subject to a fine of $150 for the first offense. Any person who commits a second or subsequent violation of §§ 130.50 through 130.55 shall be subject to a fine of not less than $350 nor more than $1,000. Fines may be imposed on a per violation basis.
