No person shall construct, erect, install, or locate any building or structure, public or private, without first obtaining a building permit as herein provided. (Ord. 351, 5-18-1982)
The building inspector shall be given at least twenty four (24) hours' notice of the starting of work under the building permit. Construction pursuant to the permit must begin within ninety (90) days of its issuance. The permit will expire at the end of one year from the issuance date; however, where the size of the building project takes longer than one year to complete and/or there is a valid reason to extend the construction period beyond one year, the building inspector may grant up to two (2) 90-day extensions for the project after a showing of reasonable cause. Any person desiring to construct, erect, install or locate any building or structure in the village shall first make written application for a permit to the village clerk. At the time written application is submitted to the village clerk, the village clerk shall collect in full a fee for each building permit as hereinafter set forth. Thereafter, the village clerk shall transmit the written application to the building inspector. Upon receipt by him of the written application for a permit, the building inspector shall determine if the application is adequate and whether the proposed building or structure conforms to the requirements of this code. If the building inspector determines that the application is adequate, and further that the building or structure conforms to the requirements of this code, the building inspector shall forthwith issue an appropriate building permit. The application shall state the name of the owner of the property upon which the building or structure is proposed to be constructed, erected, installed, or located; the name and address of the applicant and if the applicant is other than the owner, whether the applicant will act as agent, servant or employee of the owner, or as an independent contractor; a brief legal description of the premises to be improved, and for this purpose the street address of the property shall be sufficient; the value of the building or structure to be constructed, erected, installed, or located; the use to which the building or structure is proposed to be put. If the proposed building or structure shall contain more than one living unit and/or more than one commercial unit, the application shall so state. (Ord. 351, 5-18-1982)
A fee for each building permit shall be paid to the village clerk at the time written application for a permit is submitted to the village clerk. The fee for each building permit shall be two dollars ($2.00) per each one thousand dollars ($1,000.00) of valuation or fraction thereof, but in no case shall the fee be less than twenty five dollars ($25.00) nor more than two hundred fifty dollars ($250.00). The determination of value or valuation under any of the provisions of this chapter, or any building code, shall be made by the building inspector, whose decision shall be final and binding. The building inspector shall have and retain for his own use and as full compensation for the services rendered pursuant to the provisions of this chapter and title 9 of this code, the fees paid hereunder pursuant to the provisions of this chapter. Where construction, erection, installation, or location, for a building or structure for which a permit is required is started, or proceeded with, prior to obtaining said permit, the fee above specified shall be tripled, but the payment of each triple fee shall not relieve any person from fully complying with the requirements of this code, in the execution of the work or from any other penalty prescribed therein, or in any other applicable provisions of this code. Additionally, the village attorney may proceed at law or in equity to enforce the provisions of this chapter, and any such enforcement action shall not relieve any person from fully complying with the requirements of this code, in the execution of the work or from any other penalty prescribed therein, or in any other applicable provisions of this code.
