§ 116.14 TAXICABS TO BE OPERATED DAILY; INSPECTION AND SUSPENSION OF LICENSE.
   (A)   All licensed taxicabs shall be regularly and daily operated during each day of the license period to the extent reasonably necessary to meet the public demand for taxicab service.
   (B)   All taxicabs shall be subject to inspection at any time by the Chief of Police, or by any member of the Police Department on his or her order, and if found by him or her to be, in his or her judgment, unfit for public service either by reason of not being in a thoroughly safe condition or not clean or of good appearance, the City Controller, upon receiving notice of this finding by the Chief of Police, shall suspend the license of the cab until it has been put in a condition to the approval of the Chief of Police.
   (C)   When the license is suspended, the City Controller or Chief of Police shall take up the license check attached to the taxicab and not deliver it to the licensee until the cab has been approved by the Chief of Police for operation.

§ 116.15 ANNUAL REGISTRATION OF DRIVERS.
   No person shall serve or act as a driver of a licensed taxicab unless he or she owns a license as a public passenger chauffeur issued by the Department of Motor Vehicles for the State of Indiana, and has annually applied for registration as a driver with the Controller of the city on forms to be provided by the Controller. Upon request of an application from the Controller, the applicant shall pay to the Controller the sum of $10. The application shall be completely filled in and signed before the Chief of the Elkhart Police Department or an authorized agent, who shall then make a complete record for the Police Department and furnish the applicant with a photostatic copy of the application with the approval of the Chief of Police thereon. Within 5 days from the approval of the application, the original application with the approval noted thereon, shall be returned by the Chief to the Controller. However, if it is found from the application that the applicant is unfit mentally, morally or physically, this finding will be noted on the application, and the application will be returned to the Controller. Any applicant who feels aggrieved by the decision of the Chief of Police denying his or her application, may within 30 days from the date of the denial, ask and receive a hearing before the Board of Public Works and Safety for the City who may, by a majority vote after a complete hearing, either confirm or rescind the decision of the Chief of Police.

§ 116.16 SUSPENSION OR REVOCATION OF TAXICAB LICENSE.
   (A)   Any taxicab license granted under the terms and provisions of this chapter may be suspended or revoked by the City Controller if the taxicab is, with the knowledge and consent of the owner, used for, or the driver is, with the knowledge and consent of the owner, engaged in immoral or illegal business in violation of any city ordinance, state or federal law. Any person aggrieved by the conduct or action of any taxicab driver or owner in the operation of the taxicab, may present a complaint to any police officer of the city, and it shall be the duty of the Police Department to promptly investigate the complaint and take appropriate action in the premises. No owner or taxicab operator shall permit any unlicensed driver or any driver whose license has been suspended or revoked, to operate any taxicab within the city.
   (B)   It shall be the duty of every person driving or operating a taxicab to be courteous, to refrain from swearing, loud talk or boisterous conduct, to permit no person of the opposite sex to occupy the seat beside him or her, unless carrying a capacity load, to drive his motor vehicle carefully and in full compliance with all traffic laws, ordinances, regulations or orders of the Police Department of the city, and to deal honestly with the public and with his employer.

§ 116.99 PENALTY.
   Any person violating any provision of this chapter shall be fined not less than $1, nor more than $100. Each day the ordinance is violated will be a separate offense.
