The following words and phrases when used in this chapter shall have the meanings prescribed in this section except in those cases where the content clearly indicates a different meaning:
ANIMAL: | Any cat, dog, horse, mule, donkey, pony, cow, sheep, goat, hog, bird, reptile, rabbit, chicken, guinea pig, goose, duck, turkey, or any other domestic animal. Animal shall mean both the male and the female, spayed or neutered. |
ANIMAL CONTROL OFFICER: | The individual designated by the mayor and confirmed by city council to enforce the animal ordinances. Said officer(s) shall be appointed for an indefinite term, and may be removed by the mayor. The salary of the animal control officer(s) shall be established by the city council, and may be either on a salary basis or a contractual fee system related to enforcement activities. If the animal control officer is paid on a contractual fee system the animal control officer shall receive fifty dollars ($50.00) per each animal "at large"; one hundred dollars ($100.00) for each "dangerous dog," "potentially dangerous dog," "vicious dog or animal" as defined under this chapter; seventy-five dollars ($75.00) per rodents/varmints; and twenty-five dollars ($25.00) for miscellaneous or as otherwise provided in a contract approved by the City Council. Prior to receiving payment, the animal control officer shall provide the city clerk with a log of enforcement activities performed for the month of payment, which shall include categories of "at large"; "dangerous dog," potentially dangerous dog," "vicious dog or animal," "rodents," "varmints," and "miscellaneous." |
ANIMAL WELFARE COORDINATOR: | Shall be the administrator of the Elgin Animal Shelter and shall maintain the facility, animals, and all records in accordance with all federal, state, and municipal laws. |
AT LARGE: | An animal that is not confined to premises owned, leased, occupied or otherwise under the control of, the owner by a fence of sufficient strength and height to prevent the animal from escaping; secured by a leash or a chain of sufficient strength to prevent the animal from escaping from the owners premises; or not under the control of the owner, a member of his immediate family over twelve (12) years of age or an agent of the owner, by leash or otherwise, whether on the owners premises or not. |
EXOTIC ANIMAL: | Any animal that is not native to the State of Oklahoma, such as foreign or imported animals. |
LIVESTOCK: | Any animal normally kept for farm agricultural purposes; including, but not limited to horses, mules, donkeys, cattle, goats, sheep, hogs, llamas, hens, ducks, geese, or other fowl. Roosters shall not be allowed within the city limits of Elgin unless on the premises of land zoned agricultural. |
OWNER: | Any person owning, harboring or keeping an animal. The occupant of any premises on which a domesticated or tamed animal remains, or to which it customarily returns, for a period of three (3) days or more, shall be deemed to be harboring or keeping the animal. |
SWINE: | Any pig, hog or pot-bellied pig. Swine shall not be allowed within the city limits of Elgin except as set out specifically hereinafter. |
VICIOUS DOG: | A dog which has bitten or attempted to bite, any person or another animal without undue provocation, or which attacks, or barks or growls at and acts as if it intended to attack or bite, or bites a person or persons or another animal, when not unduly provoked. |
WILD ANIMALS: | Any animal known to be a predator or which is known to have vicious characteristics or which is not bred for domestic purposes, which commonly exists in a natural unconfined wild state, or which is not normally considered domesticated, regardless of the duration of captivity. It shall be unlawful for any person raising, owning or keeping any animal to permit said animal to run at large, outside of the visual range of the owner, upon the public streets, alleys, parks or other public property of the city or to enter any private premises not owned by the caretaker of said animal. All animals running at large in violation of this section shall be taken to the animal shelter. Any owner, keeper or custodian of an animal who shall allow said animal to run at large shall be guilty of a misdemeanor and fined one hundred ten dollars ($110.00). (Ord. 22-05, 3-10-2022)
