5-6-2: Storage Of Explosives
5-6-1: SALE, POSSESSION OR DISCHARGE OF FIREWORKS:
   A.   Storage And Discharge Restrictions: It shall be unlawful and an offense for any person, firm or corporation to store or discharge, ignite or in any manner aid, assist or abet in the discharging or igniting of any firework of any size, type or description within the corporate limits of the city except as provided below in subsections A1 through A4.
Persons within the city limits may use or otherwise discharge permissible fireworks only from three o’clock (3:00) P.M. to ten o’clock (10:00) P.M. on the Saturday prior to July 4, July 3 and July 4 and from ten o’clock (10:00) P.M. on December 31 until one o’clock (1:00) A.M. on January 1, provided the following conditions are met:
      1.   Such fireworks must be discharged on a noncombustible surface of sufficient size to contain the entire ground portion of the display and not closer than twenty five feet (25') to any permanent structure. Except: It shall be unlawful to explode or ignite fireworks within five hundred feet (500') of any church, hospital, asylum, unharvested flammable agricultural crop, public school or where fireworks are stored, sold, or offered for sale. No person shall ignite or discharge any permissible articles of fireworks within or throw the same from a motor vehicle; nor shall any person place or throw any ignited article of fireworks into or at such a motor vehicle or at or near any group of people.
      2.   An adult must be physically present for any household member to use fireworks and said use shall be within sixty feet (60') of the front door of the residence. The residential owner is responsible for cleaning up any debris caused by any person discharging fireworks and such debris must be cleaned up and removed the same day the fireworks are discharged.
      3.   Private persons may not use or discharge fireworks within any city park, nor on any highway, turnpike, or any street that has paving in excess of twenty six feet (26') wide, such as an arterial street, or collector street. Provided, that the mayor and city council may order or permit public display of fireworks by properly qualified individuals under the direction of experts in the handling of such fireworks.
      4.   A violation of this section shall, upon conviction thereof, be punished by a fine of two hundred eighty dollars ($280.00) plus costs. Each violation shall constitute a separate offense.
   B.   Penalty:
      1.   Any person, firm or corporation who violates this section shall be fined a sum not to exceed the limits established in subsection 1-9-7B2 of this code; provided, however, any person, firm or corporation who violates this section during a burn ban shall be fined a sum not more than five hundred dollars ($500.00).
      2.   The term "burn ban", as used in this subsection, shall mean any gubernatorial proclaimed extraordinary danger from fire or extreme fire danger resolution passed by the Comanche County Board of Commissioners pursuant to 2 Oklahoma Statutes section 16-26. 5-6-2: STORAGE OF EXPLOSIVES:
   A.   Compliance With State Law:
      1.   It shall be unlawful for any person to store, keep, have on their premises or in their possession any explosive materials of any kind or nature without first having complied with the laws of the state of Oklahoma for the purpose of selling, storing or keeping such articles.
      2.   Any person storing explosives for sale to the general public must comply with the laws of the state of Oklahoma concerning the sale and storage of said explosives.
   B.   Storage Near Dwelling Or School: It shall be unlawful for any person to keep or store any explosive on any premises which are occupied as a dwelling or school. (1991 Code § 7-31)
