(a) Any person affected by any notice which has been issued by the Chief Building Official or his authorized representative under any provision of this chapter or any rule or regulation adopted pursuant thereto may request and shall be granted a hearing on the matter before the Chief Building Official. The person requesting a hearing shall, within ten days from the day the notice was served, file in the office of the Chief Building Official a written petition which shall contain a brief statement of the grounds for the hearing. The Chief Building Official shall immediately set a time and place for the hearing and shall give the petitioner written notice of it. The hearing shall be held before the Chief Building Official not more than ten days from the day the petition was filed, except that upon application of the petitioner or upon his own motion the Chief Building Official may delay the time of the hearing for not more than forty days from the day that the petition for a hearing was filed if there is good and sufficient reason for delay. The petitioner shall have the right to appear at the hearing in person or to be represented by an attorney or by any other person.
(b) The Chief Building Official or the authorized representative shall promptly report to the Director of Law and the City Prosecutor the names and addresses of all persons, firms and corporations who have violated or failed to comply with this chapter who are subject to it. The Director of Law and the City Prosecutor shall proceed against such persons, firms or corporations civilly and/or criminally as provided in Sections 1385.18 and 1385.99.
