A. Violation; Penalty Imposed: Any and all persons who shall violate any of the provisions of this title or any code or regulations adopted by this title, or fail to comply therewith, or who shall violate or fail to comply with any order or regulation made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved hereunder, or any certificate or permit issued hereunder, shall be guilty of an offense against the city, and, upon conviction thereof, shall be subject to penalty as provided in section 1-4-1 of this code. Provided, that each and every day upon which such violation or failure to comply, or prohibited conditions are continued or persisted in, shall constitute a separate offense, and shall be punished accordingly.
B. Remedial Action: The imposition of a penalty for the violation of this title, or any part thereof, shall not preclude the city, or the officials thereunder, from the enforced removal of prohibited conditions, as provided herein, and shall not preclude the city, or the officials thereof, from enjoining and restraining the unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use of any building or other structure within the city, as provided by ordinance.
