§ 152.033 LIGHT INDUSTRIAL ZONE L-I.
   In an L-I Zone, the following regulations shall apply.
   (A)   Uses permitted outright. In an L-I Zone, the following uses and their accessory uses are permitted, subject to the provisions of §§ 152.055 through 152.076, 152.115 through 152.117, and 152.225 through 152.235, where applicable:
      (1)   Multi-family dwelling;
      (2)   Retail store or shop, such as food store, gift shop, drug store, apparel store, hardware store, furniture store, or similar establishment;
      (3)   Repair shop for the type of goods offered for sale in those retail trade establishments permitted in a C-1 Zone, provided all repair shall occur entirely within an enclosed building;
      (4)   The manufacture, fabrication, and/or assembly of those goods offered for sale on the premises, provided all manufacturing, fabrication, assembling, and storage not to exceed 50% of the total floor area of the establishment;
      (5)   Personal or business service establishment, such as barber or beauty shop, laundry or dry cleaning establishment, tailor shop, or similar establishment;
      (6)   Clinic;
      (7)   Club, lodge, or fraternal organization;
      (8)   Financial institution;
      (9)   Indoor commercial amusement or recreation establishment, such as bowling alley, theater, or pool hall;
      (10)   Mortuary;
      (11)   Newspaper office or print shop;
      (12)   Office;
      (13)   Private museum, art gallery, or similar facility;
      (14)   Restaurant, bar, or tavern;
      (15)   Automobile service station, including minor repairs;
      (16)   Laundromat;
      (17)   Retail sale of sporting goods or bait;
      (18)   Automobile, truck or trailer sales, service, storage, rental, or repair;
      (19)   Boat or marine equipment sales, service, storage, rental, or repair;
      (20)   Cabinet or similar woodworking shop;
      (21)   Cold storage or ice processing plant;
      (22)   Feed or seed store;
      (23)   Implement, machinery, or heavy equipment sales, service, storage, or rental;
      (24)   Laboratory for experiment or research;
      (25)   Lumber or building materials sales and storage;
      (26)   Machine, welding, sheet metal, or similar metal working shop;
      (27)   Plumbing, heating, electrical, roofing, or paint contractors, storage, repairs, or sales shop;
      (28)   Tire sales, repair, re-treading, or vulcanizing;
      (29)   Truck terminal or freight depot;
      (30)   Warehouse or storage area;
      (31)   Wholesale establishment;
      (32)   Time share projects;
      (33)   Condominiums;
      (34)   Public or private parking lots;
      (35)   Manager/owner/caretaker residence;
      (36)   Parking area or meeting requirements of § 152.058 of this chapter;
      (37)   Tourist accommodation or resort; and
      (38)   Commercial fishing gear storage.
   (B)   Conditional uses permitted. In an L-I Zone, the following uses and their accessory uses may be permitted subject to the provisions of §§ 152.055 through 152.076, 152.115 through 152.117, 152.130 through 152.136, and 152.225 through 152.235, where applicable:
      (1)   Community center;
      (2)   Governmental structure or use of land;
      (3)   Public park, playground, or swimming pool;
      (4)   Public or private utility facility;
      (5)   Radio or television transmitter or tower;
      (6)   Solid waste disposal transfer station;
      (7)   Recreational vehicle park;
      (8)   Drive-in services, such as a drive-in restaurant;
      (9)   Billboards;
      (10)   Kennel;
      (11)   Animal hospital;
      (12)   A use involving manufacture, research, repair, assembly, processing, fabricating, packing, distribution, warehousing, wholesaling, or storage, provided that the use does not create a public nuisance or an unreasonable hazard to health or property because of excessive noise, smoke, odor, or dust or because it constitutes a fire, explosion, or other physical hazard;
      (13)   Mobile vending stand;
      (14)   Except that the following uses are prohibited in an L-I Zone:
         (a)   Cement, lime, gypsum, or plaster of Paris manufacture;
         (b)   Explosives storage or manufacture;
         (c)   Fertilizer manufacture;
         (d)   Gas manufacture;
         (e)   Glue manufacture;
         (f)   Petroleum or petroleum products refining;
         (g)   Pulp mill;
         (h)   Rendering plant;
         (i)   Slaughterhouse or stock yard;
         (j)   Smelting or refining of metallic ore; and
         (k)   Other uses similar to the above.
      (15)   Churches and religious organizations, subject to the following special, supplemental requirements:
         (a)   The proposed location is suitable, considering:
            1.   The size, design, and operating characteristics of the proposed use;
            2.   The adequacy of transportation access to the proposed location; and
            3.   The natural and physical features of the site, such as general topography, natural hazards, natural resource values, and other features.
         (b)   The proposed use is compatible with exiting and projected uses on surrounding lands, considering the factors in division (B)(15)(a) above;
         (c)   No adverse impact to existing and projected surrounding properties and uses shall occur due to on-street parking upon compliance with the off-street parking requirements in § 152.058 of this subchapter; if an adverse impact is found to exist notwithstanding compliance with the off-street parking requirements in § 152.058 of this chapter, the off-street parking requirements shall be increased to one parking space for each three persons, as determined by the maximum occupancy by the Fire Marshal, in the assembly area;
         (d)   All off-street parking shall be located on the same lot or on lot(s) immediately adjacent to the church or religious organization, provided however that no off-street parking shall be located across a state highway or arterial, or commercial or industrial street (as defined by the Comprehensive Plan or its successor, or resolution of the City Council); and
         (e)   A waiver of remonstrance, recognizing the rights of property owners within the L-I Zone to use their property for the purposes permitted within the L-I Zone, to be recorded with the County Clerk.
      (16)   Child care.
   (C)   Standards. Except as provided in this section and in §§ 152.055 through 152.076, 152.115 through 152.117, and 152.225 through 152.235, the standards which apply in the C-1 Zone shall apply in the L-I Zone.
      (1)   All yards abutting a lot in a residential zone shall be a minimum of 20 feet.
      (2)   Outdoor storage abutting or facing a street or highway or a lot in a residential zone shall be screened with a sight-obscuring fence.
      (3)   No building in the L-I Zone shall exceed a height of 40 feet.
      (4)   Kennels shall be located:
         (a)   No closer than 75 feet from a residential zone; and
         (b)   No closer than 20 feet from a property line.
      (5)   All uses allowed either outright or conditionally in the L-I Zone involving manufacture, repair, assembly, processing, or fabricating shall be conducted entirely within an enclosed building. The manufacture or repair of boats shall be exempted from this requirement.
