(a) Possession or Consumption of Alcoholic Beverages Prohibited. No person shall possess or consume alcoholic beverages on the municipally owned lands of the Village Municipal Park, unless permission has been granted by the Village Council.
(b) Horses Prohibited. No person shall ride or walk a horse on the municipally owned lands of the Village Municipal Park.
(c) Operation of Motor Vehicles Prohibited; Exception. No person shall operate or park a motor vehicle (including mini-bike and motorcycle) or permit such motor vehicle to be driven or parked on the municipally owned lands of the Village Municipal Park, except on designated roads, driveways, and parking area provided for such purposes on the municipally owned lands of the Village Municipal Park, unless permission has been granted by the Village Park Board.
(d) Park Hours.
(1) No person shall be on the municipally owned lands of the Village Municipal Park from midnight to 6:00 a.m.
(2) No person shall operate a motor vehicle (including mini-bike and motorcycle) or permit such motor vehicle to be driven or parked on the municipally owned lands of the Village Municipal Park from midnight to 6:00 a.m.
(e) Operation and Maintenance of Park. The following duties and responsibilities shall apply for the Park Manager, Pool Manager, Park Board, Concession Manager and Village pertaining to the operation and maintenance of the Village Municipal Park:
(1) Park Manager.
A. Prepare diamonds;
B. Trim mowing;
C. Restroom care;
D. Lighting;
E. Shelter house repair and maintenance;
F. General clean up;
G. Responsible for all park equipment and year end inventory;
H. Responsible for opening and closing basis; and,
I. Any further duties, responsibilities and qualifications as set forth in the Park Manager job description set by the Village Administrator.

(2) Pool Manager.
A. Prior to the pool season.
1. Coordinate with the Administrator to clean up the pool and to determine jobs necessary to get the pool in ready condition;
2. Obtain purchase order information from the Finance Director;
3. Contact all guards to schedule them for pool opening preparation;
4. Familiarize yourself with Pool Handbook and duties thereon;
5. Obtain sizes of all guards to order swim attire.
B. During season.
1. Schedule all guard hours, including their time off;
2. Keep bath house and pool area clean;
3. Handle all complaints and if unable to handle them, refer them to the Administrator;
4. Ensure that the periodic testing is done and recorded;
5. Keep required records;
6. Deposit funds at the Village Offices daily.
7. Attend all Park Board meetings during the season, and report the monthly activities;
8. Turn in payroll records at the Payroll Clerk’s office on Monday of pay week by 9:00 a.m.
C. After the season ends.
1. Manage the proper closing of the pool, placing removable items in storage.
2. Give the bath house a final cleaning;
3. Prepare and distribute a final year end report to the Park Board as detailed in the Pool Handbook; and
4. Give recommendations for next season to Park Board.
D. All other duties as assigned.
(3) Concession Manager.
A. Buying and setting prices for all goods sold in the stand with the Administrator’s assistance.
B. Open the stand when there are sufficient crowds to be worthwhile.
C. Be available to open for swim team meets;
D. Be available to open on weekends when tournaments are played;
E. Be available during soccer season, end of March through April and mid September to mid October on weekends;
F. Deposit funds at the Village Offices daily.
G. Cleaning the stand and food processing equipment each night.
H. Ability to train staff for stand operation and cleaning of equipment.
I. Supervise the concessions stand as well as the employees.
J. Check with office to see about changes in team schedules and tournaments; and
K. Any further duties, responsibilities and qualifications as set forth in the Park Manager job description
(4) Park Board.
A. Recommend to Council any capital improvements to the park.
B. Scheduling of all activities at park.
(5) Village.
A. The Village will be responsible for the operation of all concessions on park property. Any organization seeking to utilize either the permanent concession stand or establish a temporary stand for special events shall be required to obtain the approval of the Village Administrator. Those organizations must agree to abide by all rules and regulations governing the operation of the stand including, but not limited to, the management of funds.
B. The Village Administrator will be responsible for the hiring of seasonal employees, including a Concession Manager and Pool Manager.
C. Each manager shall be responsible for accounting for all costs and revenues and turning revenues in to the Finance Director on a daily basis.
D. The Village Council shall have final jurisdiction of all matters relating to the operation and maintenance of Village Municipal Park. (Ord. 10-20. Passed 5-3-10.)
(f) Rates for use of Shelter Houses and Ball Diamonds. Non-profit organizations can use the Fernwood Wildwood shelter houses at no charge, provided a certificate of recognition is on file with the Village Clerk. For all other users of the shelter houses or ball diamonds, the Administrator shall set a rate on an annual basis with Council’s approval by motion. Said rate shall be set only after consideration of the recommendations of the Park Board pursuant to this chapter.

(a) Rules and Regulations. To protect the health, safety, and welfare of the general public in the use and enjoyment of the Municipal swimming pool, the following rules and regulations are enacted for all swimmers and users of the Municipal swimming pool.
(1) A. No running in pool area.
B. No gum chewing in pool area.
C. No rough housing, horse play, or pushing in pool area.
D. No shoes on deck area.
E. No smoking on deck area.
F. No tag playing on deck area.
G. No diving off sideways on either diving board.
H. One person at a time on the diving board.
I. No ducking in the pool.
J. No profane language.
K. Diving permitted only in deep end of pool.
L. No persons are permitted in the Pool Director's office except employees and other authorized persons.
M. No kickboards or other floating supports to be used in the pool.
N. No one permitted in the dressing rooms without an admission ticket and dressing basket.
O. No food or soft drinks in container or bottle allowed in dressing rooms or on deck area.
P. No one permitted in pool without proper bathing attire.
Q. No one shall enter the deep end of pool unless they are able to swim five times the length of the pool.
(2) The Pool Director and Assistant Pool Director shall be responsible for enforcement of all rules and regulations and shall have the right and authority to remove from the pool area all persons in violation of these rules and regulations.
(b) The Village Park Board may promulgate further such rules and regulations in the use of the Municipal swimming pool as are necessary for the health, safety, and welfare of the public in the use and enjoyment of the Municipal swimming pool.

(c) Admission Rates. There shall be paid by each person for the use and enjoyment of the Municipal swimming pool, an admission charge, except Independence Day when admission is free, as follows:

All Pool passes will be issued at the Village offices. For a family pass, the names of those people in the immediate family shall be provided at the time the pass is issued. A family Pass is defined as Husband, Wife, Home Care Provider and Child(ren). A resident is defined as P-D-Y school district residents.
The term “Child” means a child who meets all of the following conditions:
1. Is a natural child, stepchild, legally adopted child, who is substantially dependent upon the Delta resident for support and for whom the Delta resident has a legal responsibility to support.
2. A child will be assumed a dependent if such child is considered a “Dependent” of the participant for federal income tax exemption purposes under Section 152 of the Internal Revenue Code of 1986, as amended.
3. In unmarried.
4. Is less than 19 years of age; unless the child is enrolled full-time in an institution of higher learning, and said child’s age is less than 23; provided that there shall be no age limitation if the child is “incapacitated”.
(d) Rental Fees. The Municipal swimming pool may rented by individual or groups at an hourly rental charge as follows:
(1) Resident | $60.00 per hour |
(2) Nonresident | 75.00 per hour |
The pool may be rented to individuals or groups only after the regular swimming hours.

(e) Recreation Fund. The funds received from the collection of the admission rates in subsections (c) and (d) hereof shall be deposited as received with the Clerk of Council, who shall keep the same in a separate fund designated the Village Recreation Fund.
