(a) Definition. For the purpose of this section the following definition shall apply unless the context clearly indicates or requires a different meaning.
“Person” or “user” includes individuals, organizations, firms, and corporations.
(b) Application for Use. Any person who desires to use the auditorium or kitchen facilities of the Village Memorial Hall shall make application to the Village Clerk for reservation of the use of such facilities.

(c) Fees; Payment.
(1) There shall be paid to the Village the following fees for the use of the auditorium or kitchen facilities of the Memorial Hall.
A. Commercial use.
1. One hundred and fifty dollars ($150.00) for the use of the auditorium and/or kitchen facilities per session for a commercial business in the Village corporation limits;
2, Two hundred dollars ($200.00) for the use of the auditorium and/or kitchen facilities per session for a commercial business not in the Village corporation limits;
3. Fifteen dollars ($15.00) per hour thereafter; and
4. A session is hereby defined as the use of the facility eight hours or less in a single day.
5. Set up and tear down by the Village shall be a twenty-five dollar ($25.00) charge.
6. Two hundred dollar ($200.00) refundable security deposit to be held until a post rental inspection is conducted. If the hall has not been cleaned then one hundred dollars ($100.00) of the deposit will be applied as a cleaning fee.
B. Private use.
1. Two hundred dollars ($200.00) for the use of the auditorium or kitchen facilities per session for Village resident;
2. Two hundred and fifty dollars ($250.00) for the use of the auditorium or kitchen facilities per session for a nonresident of the Village.
3. Fifteen dollars ($15.00) per hour thereafter.
4. A session is hereby defined as the use of the facility eight hours or less in a single day.
5. Set up and tear down by the Village shall be a twenty-five dollar ($25.00) charge.
6. Two hundred dollar ($200.00) refundable security deposit to be held until a post rental inspection is conducted. If the hall has not been cleaned then one hundred dollars ($100.00) of the deposit will be applied as a cleaning fee.
C. Public use. There will be no rental charge, security deposit or cleaning fee required for public use of the facility. A fee of twenty dollars ($20.00) shall be charged for the use of the auditorium or kitchen facilities. However, in the application for a certificate of recognition as provided for in subsection (f)(3) hereof, a nonprofit organization may apply for a waiver of the twenty dollar ($20.00) fee, which application for waiver shall be accepted or rejected by the Village Council. The Village will accept donations by groups wishing to offset the cleaning costs even if the group was granted a Certificate of Recognition.
D. Funeral services and funeral dinners. There will be no rental charge or deposit required for use of the facility for funeral or funeral dinners. However, damage to the facility or not properly cleaning the facility will result in a loss of future hall privileges.
(2) All fees for the use of the auditorium or kitchen facilities of the Memorial Hall shall be payable in advance to the Village Clerk.

(d) Commercial Use. A commercial use is any use of the auditorium or kitchen facilities of the Memorial Hall wherein an admission is charged, a collection is taken, or any means for making money are used whether direct or indirect, such use shall be deemed for commercial purposes.
(e) Private Use. A private use is any use of the auditorium or kitchen facilities of the Memorial Hall as to which the public is not invited or expected and shall include the use by all clubs and organizations which have a membership, excepting nonprofit organizations hereinafter issued a certificate of recognition for the public use.

(f) Public Use.
(1) A public use is any use of the auditorium or kitchen facilities of the Memorial Hall by a nonprofit organization whose primary purpose is to serve the public health or welfare, and the majority of its membership are residents of the Village, have a Village mailing address, are residents of the Pike-Delta-York School District, or any of the above.
(2) Any club or organization may make application to the Village Council for a public use of the auditorium or kitchen facilities of the Memorial Hall and be designated a nonprofit organization as defined in subsection (f)(1) hereof, which application shall be accepted or rejected by the Council.
(3) The Council shall upon acceptance of the application of a club or organization as provided in subsection (f)(1) hereof issue the club or organization a certificate of recognition to be eligible to use the facilities of the Memorial Hall as a public use. The certificate of recognition shall be filed with the Village Clerk.
(4) The Council may by motion, withdraw the certificate of recognition of any club or organization hereinafter designated as entitled to the use of the auditorium or kitchen facilities of the Memorial Hall as public use after 30 days notice thereof to the club or organization at its listed address or any officer thereof residing in the village, after finding that the club or organization are no longer qualified as defined in subsection (f)(1) hereof or have abused the privilege of use as a public use.
(5) Any individual, club, or organization may make application to Council of the Village for a public use of the auditorium or kitchen facilities of the Memorial Hall for a particular event or date, to which the general public is invited and which serves the public health or welfare, which application shall be accepted or rejected by the Council of the Village. Acceptance of the application shall not be designation of the individual, club, or organization to an unlimited use of the auditorium or kitchen facilities of the Memorial Hall as a public use.

(g) Procedure for Set Up and Clean Up.
(1) Tables and chairs are to be set up and replaced as designated by the Village by the user of the auditorium or kitchen facilities.
(2) An additional fee of fifteen dollars ($15.00) shall be made to the user if Village employees are requested to set up chairs and tables for the user or replace the chairs and tables to their proper places.
(h) Opening and Closing.
(1) The auditorium or kitchen of the Memorial Hall shall be available to a user between the hours of 9:00 a.m. through 2:00 a.m and shall not be opened to any user prior to the hour of 9:00 a.m. and shall be closed to any user at 2:00 a.m. Any user holding over after 2:00 a.m. shall be charged fifteen dollars ($15.00) for each hour or portion thereof held over.
(2) Each user shall be entitled to one opening and closing of the auditorium.
(3) An additional fee of ten dollars ($10.00) shall be charged to the user for each additional time a Village employee is requested to open or close the auditorium for the user.

(i) Damage; Deposit.
(1) The user of the auditorium and/or kitchen facilities shall be responsible and liable to the Village for damages incurred to Village property during the use of the facilities and for that purpose the following deposit shall be made with the Village Clerk at the time of application:
A. For a commercial use or private use, one hundred dollars ($100.00) to insure the payment of damages if any, and the one hundred dollars ($100.00) deposited or any part thereof shall be returned to the commercial user or private user upon inspection by the custodian of the Memorial Hall and his approval thereof.
B. For a public use, twenty dollars ($20.00) to insure the payment of damages if any, and the twenty dollars ($20.00) deposited or any part thereof shall be returned to the public user upon inspection by the custodian of the Memorial Hall and his approval thereof.
(2) Any cleanup of the facilities of more than six man-hours, shall for the purpose of this section be deemed damaged.
(3) In the event the custodian of the Memorial Hall disapproves the return of the deposit to the user, the Village Clerk shall retain the deposit until the Village Council has determined the damages, if any, and the cost thereof, and then the Village Clerk shall apply the deposit against the cost of the damages. The liability for cleanup damages shall be at the regular hourly rate of wages for Village employees engaged in the cleanup of the facilities. (Ord. 1236. Passed 12-18-78; Ord. 93-33. (j) Use Regulations to be Posted.
(1) Each user of the auditorium or kitchen facilities shall be subject to the use regulations for such facilities and the Memorial Hall.
(2) The use regulations shall be posted in the auditorium and kitchen and in the office of the Village Clerk.
