961.03 MUNICIPAL RESERVOIR AND POND.
   (a)   Certain Acts Prohibited. It is unlawful to:
      (1)   Operate any motor driven vehicle, of any design whatsoever, any place on a reservoir property other than those roadways designated for public access to parking, picnic areas, observation, boat launching and landing areas. Motor driven vehicle includes but is not limited to snowmobiles, all terrain vehicles, and four-wheel drive vehicles.
      (2)   Operate any motor vehicle, of any design whatsoever, anywhere on reservoir property contrary to the instructions of any traffic-control device, light, or sign.
      (3)   Park any motor vehicle at any other location than those designated as parking areas.
      (4)   Tamper with or remove any sign placed by the Village or the Department of Natural Resources or tamper with or remove any cable or other device designed to restrict public access.
      (5)   Alter, deface, or destroy any sign, structure, tree, shrub, fence, barrier, or any other physical feature located on reservoir or pond property.
      (6)   Remove, rearrange, or throw any stones placed along an embankment as wave protection or any stone placed as road surface, boat launching surface, or decorative purpose. Also, any stone, concrete, or similar fixtures placed or erected by the Village or Department of Natural Resources to provide a specific service.
      (7)   Dispose of any items in the water, on the inside or outside embankment, on the ground or roadways of the recreational area. Refuse containers are provided for this purpose.
      (8)   Commit any nuisance in connection with the disposition of human body wastes at any location on reservoir property except at latrines provided.
      (9)   Allow animals to swim in reservoirs or ponds.
      (10)   Ride or exercise a horse on reservoir or pond property.
      (11)   Drink or possess alcoholic beverage, on reservoir or pond property.
      (12)   Possess, carry, or use firearms or dangerous ordnances (fireworks and the like) on reservoir or pond property except when engaged in the lawful hunting of ducks.
      (13)   Commit any act that is detrimental to the use of the reservoir or pond as a public water supply source or public recreation area or interfere with those people who are engaged in the lawful use of the reservoir or pond for recreational or Village or state purposes.
      (14)   To exceed the speed of 15 miles per hour on roadways and parking areas of the reservoirs or pond.
      (15)   To draw water into bulk tanks, single or multiple containers for the purpose of supplying water for use other than recreational at the facility.
   (b)   Swimming Prohibited. Recreational swimming or wading is not allowed in reservoirs or pond.

   (c)   Scuba Diving Restrictions. Scuba diving for training and recreational purposes will be permitted in the new reservoir.
      (1)   Divers must be certified by proper regulatory body.
      (2)   A diving permit must be obtained from the Village office no more than ten days before diving.
         A.   The permit fee will be set at twenty-five dollars ($25.00) for a use permit and five dollars ($5.00) per person for a diving session.
         B.   Fire Departments and other professional safety groups can be issued a permit at no cost for training purposes.
         C.   A permit is also a release form.
      (3)   Diving rules:
         A.   Divers must have permission from Village.
         B.   No single diving, minimum of two divers per dive.
         C.   Full gear required for diving, such as mask, snorkel, fins, life vest, wet suit, and tank.
         D.   Life vest must be worn.
         E.   No swimming permitted.
         F.   Inner tubes with flags allowed.
         G.   Diver marker flags are required if no diving area is roped off.
         H.   Only scuba tanks are allowed. (No other devices may be used.)
         I.   The Village and the State Department of Natural Resources are not responsible for stolen goods.
         J.   No spear guns allowed.
         K.   No snorkeling outside of diving area. If no area is roped off, no snorkeling will be allowed.
         L.   All rules must be followed. Anyone disobeying these rules will be removed from premises, cited, or denied further use of the facility.
         M.   Diving will be only during daylight hours unless by special permit by the Village and then only for training purposes.
         N.   Diving will not be allowed within 100 feet of water supply intake tower.
         O.   Ice diving will not be permitted unless by special permit by the Village and then only for training purposes.
         P.   Divers are required to remain in specified diving area if so marked by floating buoys and the like.

   (d)   Boating. The operation of watercraft on the reservoirs and pond shall be subject to watercraft laws of state.
      (1)   No person shall operate or use a conveyance equipped with a gasoline engine on either the old or new reservoir.
      (2)   Rowboats, sailboats, canoes, paddle boats, rubber rafts (military style), electric powered engines and wind surf craft are permitted on the reservoirs and pond.
      (3)   A.   Row boats, sail boats, canoes, paddle boats, rubber rafts (military style), and wind surf craft are permitted on the reservoirs and pond.
         B.   Inner tubes, rafts, and inflatable flotation devices for recreational swimming are not permitted on reservoirs or pond.
      (4)   Ice boats are permitted on the old reservoir and pond. Ice boats will not be permitted to operate in designated ice skating areas.
      (5)   Ice boats will not be permitted on the new reservoir.
      (6)   All persons operating or using any type of watercraft will wear a state and federal government approved life jacket or life belt.
      (7)   All watercraft will be launched or landed at the boat ramps provided except in case of emergency.
      (8)   No person shall ski on reservoirs or pond.
      (9)   All persons shall embark and disembark from boats at the boat ramp.
      (10)   Persons may boat on reservoirs 24 hours a day every day of the week.
      (11)   No boat shall cross float ropes used to signify specialty use or restricted areas.
      (12)   Reckless operation or speeding of watercraft will be sufficient grounds for removal from reservoirs or pond, citation, and denial of use of the facilities.
      (13)   Sailboats will be operated in a prudent manner to avoid capsizing.
         A.   In the event a boat is capsized, the operator shall right it as quickly as possible and return to the interior of the craft.
         B.   Intentional capsizing to provide a pretext for swimming will result in expulsion from the facility, citation, or denial of future use.
      (14)   All watercraft using reservoirs and pond will be required to be numbered and licensed according to watercraft laws of the state.
      (15)   Upon receiving a command or request from any law enforcement officer, park ranger, game warden, or duly authorized person, the operator or occupants of any watercraft shall immediately comply with such command on request. (Ord. 1432. Passed 12-17-84; Ord. 96-7. Passed 5-6-96.)
   (e)   Fishing.
      (1)   Recreational fishing will be permitted on the reservoirs and pond.
      (2)   Recreational ice fishing will be permitted on the reservoirs and pond.
         A.   Ice fishing sheds will be marked with name and address of owner.
         B.   No ice fishing sheds will be allowed to remain on the reservoirs or pond when not in use.
      (3)   Fishing from shore or boat will not be permitted in scuba diving areas unless no diving is being done. Persons fishing in these areas will relinquish and relocate in proper areas should diving commence.
      (4)   Ice fishing will not be permitted within 50 feet of designated ice skating areas.
      (5)   Persons fishing will comply with state laws governing recreational or sport fishing.
      (6)   No person shall use the balloon fishing method on the reservoirs or pond.
      (7)   No person shall fish within 50 feet of the boat launching ramp or parking lot on the dike of the new reservoir.
      (8)   No person shall fish within 50 feet of the boat launching areas at the old reservoir or pond.
   (f)   Hunting.
      (1)   Only duck hunting will be permitted at reservoir and pond facilities and then only in strict accordance with the laws of the state.
      (2)   It is unlawful to discharge any firearms within 400 feet of any structure or parking lot located on or contiguous to reservoir or pond property.
      (3)   No permanent duck blinds shall be erected on reservoir or pond property. Temporary duck blinds shall have the owner's name and address clearly marked and visible. (Ord. 1432. Passed 12-17-84.)
   (g)   Winter Activities.
      (1)   Sledding, snow boarding and snow skiing will be permitted as snow cover allows, but then only in the southwest corner of the new reservoir as indicated by signs placed by the Village.
      (2)   Summer sledding, snow boarding or snow skiing on reservoir banks will not be permitted.
      (3)   Ice skating shall not be permitted on either of the reservoirs or the pond.

   (h)   Camping; Picnics. 
      (1)   Camping and picnicking will be done only in specified areas.
      (2)   No campfires or cooking fires will be permitted in other than provided areas. (Ord. 1432. Passed 12-17-84.)
