933.20 UNDERGROUND WIRING DISTRICT.

   (a)    An underground district encompassing the City boundaries is hereby created.

   (b)    All persons or wire using entities operating within the district shall be required to underground their facilities within three years after the completion of the underground program in any subdistrict by the City utility.

   (c)    No person or wire using entity shall construct or maintain any pole, overhead line or associated overhead structure within the district after the completion of the underground program by the City utility in that area.

   (d)    Any person or wire using entity having poles, overhead lines or associated over head lines or associated overhead structures within the district three years after the completion of the City utility underground program, shall be guilty of a misdemeanor and subject to the penalty provided in Section 921.99. Each consecutive day's period of failure to comply shall constitute a separate offense. Such violation is hereby declared to be a nuisance and may be abated by the City in the manner providing for the abatement of nuisances.
