§ 92.99 PENALTY.
   (A)   Any person who violates any provision of §§ 92.01 through 92.08 or any order of the city issued pursuant to §§ 92.01 through 92.07 commits a summary offense and shall, upon conviction, be sentenced to pay a fine of not less than $150 nor more than $2,500 for each separate offense and, in default of the payment of such fine, may be sentenced to imprisonment for 90 days for each separate offense. Employees of the city authorized to conduct inspections or investigations are hereby declared to be law enforcement officers authorized to issue or file citations for summary violations under §§ 92.01 through 92.07, and the City Council is hereby authorized to prosecute these offenses. For purposes of this division, a summary offense may be prosecuted before any Magisterial District Justice in the city. There is no accelerated rehabilitative disposition authorized for a summary offense.
   (B)   Any person, partnership or corporation who or which has violated or permitted the violation of the provisions of this §§ 92.20 through 92.23 shall, upon being found liable therefore in a civil enforcement proceeding commenced by the municipality, pay a judgment of not more than $500 plus all court costs, including reasonable attorney fees incurred by the municipality as a result thereof. No judgment shall commence or be imposed, levied or payable until the date of the determination of a violation by the Magisterial District Justice. If the defendant neither pays nor timely appeals the judgment, the municipality may enforce the judgment pursuant to the applicable rules of civil procedure. Each day that a violation continues shall constitute a separate violation, unless the Magisterial District Justice determining that there has been a violation further determines that there was good faith basis for the person, partnership or corporation violating the §§ 92.20 through 92.23 to have believed that there was no such violation, in which event there shall be deemed to have been only one such violation until the fifth day following the date of the determination of a violation by the Magisterial District Justice and thereafter each day that a violation continues shall constitute a separate violation. These remedies are in addition to all other remedies available under law of equity, including, but in no way limited to, injunctive relief.
   (C)   (1)   A person in violation of §§ 92.38 or 92.39 commits a summary offense and upon conviction shall be punished by a fine of not less than $25 for the first offense, not less than $50 for the second offense and not less than $100 for the third and subsequent offenses.
      (2)   A person in violation of § 92.40 commits a summary offense and upon conviction shall be punished by a fine of not less than $200 for each offense.
      (3)   A person who fails to obtain the required permits as defined in § 92.36 commits a summary offense and upon conviction pay a fine of not less than three times.
      (4)   All other penalties for selling consumer fireworks, selling display fireworks and selling federally illegal explosive devices in violation of the State Fireworks Law, Act 43 of 2017, Article 24 Fireworks, are set forth in section 2414 in Act 43 of 2017, Article 24 Fireworks.
