GENERAL PROVISIONS
For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
OWNER. Any person having a right of property in any dog or cat or having custody of any dog or cat, or any person who harbors or permits a dog or cat to remain on or around his or her property.

(A) No owner of any dog or cat shall allow or permit the dog or cat to engage in repeated loud howling or barking or other unreasonable noise to the disturbance of any person any time of the day or night regardless of whether the dog or cat is physically situated in or upon private property. Such noise is hereby declared to be a public nuisance.
(B) Whenever any person shall complain to the Police Department that a dog which repeatedly barks or howls or a cat which repeatedly cries or howls is being kept by any person in the city, the Police Department shall notify the owner that a complaint has been received and direct the owner to take the necessary steps to alleviate the barking, howling and/or crying. Notification of the complaint and subsequent actions by the police officer shall be documented in the Police Department’s official records, (dog complaint/activity report).
(C) If, despite the warning by the Police Department, provided in division (B) above, the dog or cat continues to bark, howl and/or cry to the disturbance of any person and upon receipt by the Police Department of a verified complaint by a citizen of the city followed by a written statement of fact and a willingness by said citizen to testify in court, then the Police Department shall cite the owner for a violation of this subchapter.
