No person shall cause or permit a dog or cat to be present on property, public or private, not owned or occupied by such person unless such person has in his or her possession an appropriate device for cleaning up any waste by such animal for immediate transmission and deposit in an appropriate receptacle located upon property owned or possessed by such person. This section shall not apply to a handicapped individual using an animal as a guide animal.
