§ 153.32 MAJOR SUBDIVISIONS.
   (A)   Review process for single phase major subdivisions.
      (1)   General. The steps in the boxes below correspond with a detailed description of each step of the process below.
         (a)   Step 1: Pre-application meeting with sketch plan.
         (b)   Step 2: Applicant submits preliminary plat and applicable documentation.
         (c)   Step 3: Subdivision Administrator review and recommendation of preliminary plat.
         (d)   Step 4: Review and recommendation by other applicable agencies.
         (e)   Step 5: Planning Board review and recommendation of preliminary plat.
         (f)   Step 6: Town Council hearing and consideration of preliminary plat.
         (g)   Step 7: Infrastructure/improvements installed or guaranteed.
         (h)   Step 8: Applicant submits final plat and supporting documentation.
         (i)   Step 9: Subdivision Administrator review and consideration of final plat.
      (2)   Steps.
         (a)   Step 1. Pre-application meeting with sketch plan. The applicant shall schedule a pre-application meeting with the Subdivision Administrator. The applicant shall bring a sketch plan of the proposed development to the meeting that meets the requirements set forth in § 153.46.
         (b)   Step 2. Applicant submits preliminary plat and applicable documentation.
            1.   The applicant shall submit a preliminary plat in accordance with the requirements set forth in § 153.48.
            2.   The applicant shall also submit with the plat an application, fee and any other required documentation as set forth in § 153.48.
         (c)   Step 3. Subdivision Administrator review and recommendation of preliminary plat.
            1.   The Subdivision Administrator shall review the plat in accordance with the requirements of this chapter, the Zoning Ordinance and any other applicable ordinance. This review shall take not more than ten working days.
            2.   The Subdivision Administrator may have any applicable local, state and federal agencies review the plat. The ten working day limit may be extended to a total of 30 days if these agencies have been consulted and the Subdivision Administrator is awaiting a reply.
            3.   The Subdivision Administrator shall make a recommendation in writing to the Planning Board to approve, approve with modifications or deny the preliminary plat.
         (d)   Step 4. Review and recommendation by other applicable agencies of preliminary plat. The Subdivision Administrator shall provide that those public agencies concerned with new development be given the opportunity to review and make recommendations on every preliminary plat.
            1.   All recommendations shall be forwarded to the Administrator within 30 days from date of receipt.
            2.   The public agencies shall include, but are not limited to, the following:
               a.   NCDOT district highway engineer with regard to proposed streets, highways and drainage systems;
               b.   Town Public Works Department;
               c.   District Health Department with regard to proposed water and sewerage systems;
               d.   County Building Inspections Department with regard to building codes;
               e.   District Fire Chief;
               f.   District office of State Department of Environment and Natural Resources (NCDENR); and
               g.   Any other agency or official designated by the Subdivision Administrator and/or the Planning Board.
         (e)   Step 5. Planning Board review and recommendation of preliminary plat.
            1.   After having sufficiently reviewed the preliminary plat, the Subdivision Administrator shall place the item on the agenda of the next regularly scheduled Planning Board meeting.
            2.   The Planning Board shall review the plat in accordance with the requirements of this chapter, the Zoning Ordinance and any other applicable ordinance.
            3.   The Planning Board shall make a recommendation in writing to the Town Council to approve, approve with modifications or deny the preliminary plat.
         (f)   Step 6. Town Council hearing and consideration of preliminary plat.
            1.   After a recommendation is provided from the Planning Board, the Subdivision Administrator shall place the item on the agenda of the next regularly scheduled Town Council meeting.
            2.   The Town Council shall review the plat in accordance with the requirements of this chapter, the Zoning Ordinance and any other applicable ordinance.
            3.   The Town Council shall have up to 60 days to approve, approve with modifications or deny the preliminary plat.
            4.   The Subdivision Administrator shall notify the applicant, in writing, of the Town Council's action.
            5.   The final plat shall be submitted not more than two years after the date on which the preliminary plat was approved, otherwise, the approval shall be null and void unless a written extension of this limit is granted by the Town Council on or before the two-year anniversary of the approval.
         (g)   Step 7. Infrastructure/improvements installed or guaranteed. Prior to approval of the final plat, the subdivider shall have installed the improvements specified in this chapter or guaranteed their installation as provided in § 153.33.
         (h)   Step 8. Applicant submits final plat and supporting documentation. The applicant shall submit a final plat that meets the requirements of § 153.49.
         (i)   Step 9. Subdivision Administrator review and approval of final plat.
            1.   The Subdivision Administrator shall review the final plat for compliance with the approved preliminary plat, verify that all required infrastructure improvements have been completed or guaranteed in accordance with § 153.33, and ensure that the final plat meets the requirements of § 153.49.
            2.   The Subdivision Administrator shall review the plat in accordance with the requirements of this chapter, the Zoning Ordinance and any other applicable ordinances. This review shall not take more than ten working days.
            3.   The Subdivision Administrator shall notify the applicant in writing of his or her findings to either:
               a.   Approve;
               b.   Approve with modifications; or
               c.   Deny the final plat.
            4.   If the action is to disapprove the final plat, then the reasons for that action shall be stated in the letter and specific reference shall be made to the regulations with which the final plat does not comply.
            5.   The subdivider shall provide the Subdivision Administrator with a recorded copy of the plat and required documents that have been recorded with the Register of Deeds within five working days of the information being recorded. No permits shall be issued for the individual lots until the subdivider has provided a copy of the recorded plat.
   (B)   Review process for multi-phase major subdivisions.
      (1)   General. The numbers in the boxes below correspond with a detailed description of each step of the process on the following pages.
         (a)   Step 1: Pre-application meeting with sketch plan.
         (b)   Step 2: Applicant submits master plan and applicable documentation (phases shown).
         (c)   Step 3: Subdivision Administrator review and recommendation of master plan.
         (d)   Step 4: Planning Board hearing and consideration of master plan.
         (e)   Step 5: Applicant submits preliminary plat and applicable documentation of individual phase.
         (f)   Step 6: Subdivision Administrator review and recommendation of preliminary plat (individual phase).
         (g)   Step 7: Review and recommendation by other applicable agencies of preliminary plat (individual phase).
         (h)   Step 8: Planning Board review and recommendation of preliminary plat (individual phase).
         (i)   Step 9: Town Council hearing and consideration of preliminary plat (individual phase).
         (j)   Step 10: Infrastructure/improvements installed or guaranteed (individual phase).
         (k)   Step 11: Applicant submits final plat and applicable documentation (individual phase).
         (l)   Step 12: Subdivision Administrator consideration and approval of final plat (individual phase).
      (2)   Steps.
         (a)   Step 1. Pre-application meeting with sketch plan. The applicant shall schedule a pre-application meeting with the Subdivision Administrator. The applicant shall bring a sketch plan of the proposed development to the meeting that meets the requirements set forth in § 153.46.
         (b)   Step 2. Applicant submits master plan and applicable documentation.
            1.   The applicant shall submit an application, fee, master plan that meets the requirements of § 153.47, and other required materials.
            2.   A master plan showing the entire proposed subdivision and the phases of development, proposed density, proposed type and location of utilities and proposed development timetable shall be submitted to the Subdivision Administrator.
            3.   The master plan may be submitted prior to or simultaneously to submission of the preliminary plat for the first phase of development.
         (c)   Step 3. Subdivision Administrator review and recommendation of master plan.
            1.   The Subdivision Administrator shall review the plan in accordance with the requirements of this chapter and the Zoning Ordinance. This review shall take not more than ten working days.
            2.   The Subdivision Administrator may have any other applicable local, state and federal agencies review the plat. The ten working day limit may be extended to a total of 30 days if these agencies have been consulted and the Subdivision Administrator is awaiting a reply.
            3.   The Subdivision Administrator shall make a recommendation in writing to the Planning Board to approve, approve with modifications or deny the master plan.
         (d)   Step 4. Planning Board hearing and consideration of master plan.
            1.   After having sufficiently reviewed the master plan, the Subdivision Administrator shall place the item on the agenda of the next regularly scheduled Planning Board meeting.
            2.   The Planning Board shall review the plan in accordance with the requirements of this chapter and the Zoning Ordinance, if applicable.
            3.   The Planning Board shall have up to 60 days to approve, approve with modifications or deny the master plan.
            4.   The Subdivision Administrator shall notify the applicant, in writing, of the Planning Board's action.
            5.   Preliminary plats for the phases shall be submitted not more than two years after the date on which the master plan was approved, otherwise, the approval shall be null and void unless extended vested rights have been granted in accordance with G.S. § 160A-385.1 or a development agreement has been approved in accordance with G.S. § 160A-400.20-32.
            6.   Approval of the master plan must be renewed if an increase in the number of lots, number of dwelling units or overall density or a change in the connectivity to adjacent parcels or roads is proposed.
         (e)   Step 5. Applicant submits preliminary plat for individual phases.
            1.   The applicant shall submit a preliminary plat for each individual phase or several phases at once in accordance with the requirements set forth in § 153.48.
            2.   The applicant shall also submit with the plat an application, fee and any other required documentation as set forth in § 153.48.
            3.   The master plan phase lines shall be shown on the preliminary plat.
            4.   When a subdivider proposes to construct new roads without initially subdividing lots, the subdivider may present a preliminary plat to the Planning Board for approval of the roads only. This option is provided to allow developers the flexibility of designing and platting lots after road construction in order to adjust the subdivision to the existing terrain.
         (f)   Step 6. Subdivision Administrator review and recommendation of preliminary plat (individual phases).
            1.   The Subdivision Administrator shall review the plat in accordance with the requirements of this chapter, the Zoning Ordinance and other applicable ordinances. This review shall take not more than ten working days.
            2.   The Subdivision Administrator may have any other applicable local, state and federal agencies review the plat. The ten working day limit may be extended to a total of 30 days if these agencies have been consulted and the Subdivision Administrator is awaiting a reply.
            3.   The Subdivision Administrator shall make a recommendation in writing to the Planning Board to approve, approve with modifications or deny the preliminary plat.

            2.   The Town Council shall review the plat in accordance with the requirements of this ordinance and the Zoning Ordinance, if applicable.
            3.   The Town Council shall have up to 60 days to approve, approve with modifications, or deny the preliminary plat.
            4.   The Subdivision Administrator shall notify the applicant, in writing, of the Town Council's action.
            5.   The final plat shall be submitted not more than two years after the date on which the preliminary plat was approved, otherwise, the approval shall be null and void.
         (j)   Step 10. Infrastructure/improvements installed or guaranteed (individual phases) prior to approval of the final plat. The subdivider shall have installed the improvements specified in this chapter or guaranteed their installation as provided in § 153.33.
         (k)   Step 11. Applicant submits final plat (individual phases). The applicant shall submit a Final Plat that meets the requirements of § 153.49.
         (l)   Step 12. Subdivision Administrator consideration and approval of final plat (individual phases).
