14.8.110: RIGHT OF ENTRY FOR CONSTRUCTION, INSPECTION OR REPAIR OF PUBLIC STORMWATER FACILITIES:
The employees and contractors of the City shall, at all reasonable times, have access to any property within the City for emergency or general construction, inspection or repair of City owned or City operated stormwater facilities within public easements or rights-of-way and for administration and inspection for the City's NPDES stormwater programs. 14.8.111: NO ASSUMPTION OF LIABILITY BY THE CITY:
Nothing in this article is intended to relieve any owner or other person of any obligation to provide stormwater facilities or drainage imposed by this Code or any State or Federal law. Nothing in this article shall be deemed to waive any immunity or governmental protection available to the City under the Colorado Governmental Immunity Act or other State or Federal law. Further, the City expressly denies any liability whatsoever, whether for flooding or property damage or any other condition or manner. Nothing in this article shall be deemed to create any implied or actual contractual relationship between the City and any person or entity, or to imply or purport any necessity for flood insurance or other insurance protection to property. 14.8.112: SEVERABILITY:
Should any one or more sections or provisions of this article be judicially determined invalid or unenforceable, that determination shall not affect, impair or invalidate the remaining provisions of this article. City Council expressly intends that the various provisions of this article are severable. (Ord. 05-192)
