The Village and the company recognize the existence of ordinance 32, which is repealed by this chapter, previously granting a franchise to Cloudcroft TV Company a predecessor in interest to the company, and agree that the prior franchise has been recognized as effective by mutual agreement, it being the intent and understanding that there are no claims by the Village against Cloudcroft TV or the company and no claims by Cloudcroft TV or the company against the Village with respect to the location, establishment, construction, maintenance or operation of the company's lines and facilities within the Village, or amounts due to the Village under the prior franchise.
