10-2-1: DEFINITIONS:
As used in this Title, the following words and terms shall have the meanings ascribed to them in this Section:
   AVAILABLE WASTEWATER TREATMENT CAPACITY: Current capacity of existing wastewater treatment plant less the current average influent in gallons per day as determined by averaging the measurements of daily influent over the month of July for the previous two (2) years.
   CUL-DE-SAC: A street with only one outlet culminated by a turnaround.
   EASEMENT: A grant from the property owner for the use, for specific purposes, of a strip of land by the general public, or a certain person or persons, or a corporation.
   FULL PUMPING CAPACITY: Average the number of gallons that could be pumped per day over the month of July for each July for the previous five (5) years (all wells running at maximum sustainable flow for 24 hours per day and all spring water continuously collected).
   IMMEDIATE FAMILY MEMBER: Husband, wife, father, stepfather, mother, stepmother, brother, stepbrother, sister, stepsister, son, stepson, daughter, stepdaughter, grandson, stepgrandson, granddaughter, stepgrandaughter, nephew and niece, whether related by natural birth or adoption.
   PERFORMANCE BOND: A surety bond made out to the Village of Cloudcroft in an amount equal to the estimated full cost of the improvements; the cost being estimated by a New Mexico licensed engineer retained by the subdivider and under direction and control of the Village, with full approval of the Village, and said surety bond being legally sufficient to secure to the Village of Cloudcroft that the said improvements will be constructed accordance with regulations as stated in the contract.
   PLAT OR REPLAT: A map, chart, survey or plan certified by a licensed professional surveyor which contains a description of subdivided land with ties to permanent survey monuments.
   SUBDIVIDER: Any person who creates or who has created a subdivision individually or as part of a common promotional plan or any person engaged in the sale, lease or other conveyance of subdivided land. However, "subdivider" does not include licensed real estate brokers acting on another's account.
   SUBDIVISION: The division of a surface area of land, including land within a previously approved subdivision, into two (2) or more parcels by platting or by metes and bounds for the purpose of sale, lease or other conveyance or for building development. However, "subdivision" does not include:
   A.   Division of land created by court order where the order creates no more that one parcel per party;
   B.   Division of land resulting only in the alteration of parcel boundaries where parcels are altered for the purpose of increasing or reducing the size of contiguous parcels and where the number of parcels is not increased;
   C.   Division of land to create a parcel that is sold or donated as a gift to an immediate family member; however, this exception shall be limited to allow the seller or donor to sell or give no more than one parcel per tract of land per immediate family member;
   D.   Division of land created to provide security for mortgages, liens or deeds of trust; provided, that the division of land is not the result of a seller-financed transaction. (Ord. 287, 3-9-1999; amd. 2000 Code)
