9-9-4: GENERAL PROVISIONS:
   A.   Location: Off street parking facilities shall be located as hereinafter specified:
      1.   For single-family and duplex dwellings, required parking shall be located on the same lot as the building which it is required to serve.
      2.   For all other uses, required parking shall be located on the same lot or on an abutting lot. Required parking shall not be located across a public street or with an intervening property, except by conditional use permit approved by the Planning and Zoning Commission. In the event a separately owned lot is utilized, a lease shall be recorded with the Village Clerk- Treasurer.
      3.   In Commercial Zones C-1, C-2 and C-8, a variance from parking requirements may only be obtained by paying to the Village a fee to be determined by the Village Board of Trustees and based on the number of spaces not provided. (Ord. 277, 10-29-1997)
      4.   Burro Avenue retail parking from Glorietta Avenue to Mescalero Avenue/Swallow Place and that fronting Lots 1 through 8 of Block 7 and Lots 1 through 3 of Block 1 of Skywater Subdivision on Village right-of-way, whether acquired through plat dedication or conveyance, will be considered a single parking lot (similar to a shopping mall) shared by all buildings and premises that front these areas. Individual buildings and premises are not required to provide additional off street parking. However, parking space requirements for developments involving more than one lot as such may have been platted on the effective date hereof, and fronting on the area of Burro Avenue from Glorietta Avenue to Mescalero/Swallow Place will be the same as for developments not on Burro Avenue.    B.   Mixed Occupancies In Building: In the case of mixed uses in the building or on a lot, the total requirements for off street parking facilities shall be the sum of the requirements for the various uses computed separately. Off street parking facilities for one use shall not be considered as providing required parking facilities for any other use, except as hereinafter specified for joint use.
   C.   Joint Use: The Planning and Zoning Commission may authorize joint use of parking facilities when use of the facilities is primarily daytime for one applicant and nighttime for the other, or weekdays for one applicant and weekends for the other.
   D.   Submission Of Plans: The plans for any proposed commercial parking area shall be submitted to the Planning and Zoning Commission at the time of the application for a building permit for the building to which the parking area is accessory. The plan shall clearly indicate the proposed development, including location, size, shape, design, curb cuts, lighting, landscaping and other features and appurtenances of the proposed parking lot.
   E.   Surface: All off street parking facilities shall be surfaced with base course, concrete, asphaltic concrete, asphalt oil, or any other comparable surfacing and shall be maintained in good condition, free of all weeds, trash and other debris, and shall be properly drained, graded and cleared of snow.
   F.   Entrances And Exits: Entrances and/or exits shall be located at least five feet (5') from any side lot line and at least twenty five feet (25') from the side lot line on the street side of a corner lot.
   G.   Barriers: Wherever required to prevent vehicles using the parking facility from encroaching upon the public streets, alleys or sidewalks, there shall be provided a barrier not less than six inches (6") high.
   H.   Fences: Wherever a commercial parking facility abuts or is directly across the street from any residence or residential zone, such parking facility shall be isolated from such residence or residential zone by the construction of a solid fence not less than four feet (4') nor more than six feet (6') in height. With the approval of the Village, a hedge of suitable variety may be substituted for such fence.
   I.   Lighting: Lighting shall comply with title 8, chapter 3 of this Code.
   J.   Use Restrictions: The parking area shall only be used for passenger vehicles and in no case shall be used for the commercial sale, repair work, storage, dismantling or servicing of any vehicles, equipment, materials or supplies. No vehicle over twenty thousand (20,000) pounds' gross vehicle weight shall be housed in Zones R-1, R-2, R-3, T-1, T-2, M-1, G-1 or G-2.
   K.   Loading Berths: Any commercial establishment shall provide a minimum of one off street loading or unloading space. (Ord. 277, 10-29-1997)
