9-2-6: BOARD OF APPEALS:
   A.   Established: The Board of Trustees is hereby constituted as a Board of Appeals to hear any appeal made by a person aggrieved by a recommendation of the Planning and Zoning Commission.
   B.   Powers: The Board of Appeals shall have the following powers:
      1.   To hear and decide appeals where it is alleged there is an error in any determination made in the enforcement of the zoning regulations.
      2.   Where, by reason of exceptional narrowness, shallowness or shape of a specific piece of property at the time of the original adoption of the regulations or exceptional topographical conditions or other extraordinary or exceptional situation or condition of a specific piece of property, where the strict application of this title would result in peculiar and exceptional practical difficulties or exceptional and undue hardship upon the owner of the property, the Board of Trustees is hereby empowered to authorize a variation from strict application to relieve the difficulties or hardships; provided, however, that the owners of all lots within one hundred feet (100'), excluding public rights-of-way, shall be notified by certified mail, return receipt requested, of any requests for variance and of the hearing on a request at least fifteen (15) days prior to the hearing on the request for variance by the commission as set forth in this title.
