A. Level One Condition: It shall be unlawful during a level one condition outside of a fully enclosed permanent structure, camp trailer or mobile home, to build, maintain, attend or use a fire, campfire, charcoal broiler or grill producing an open flame.
B. Level Two Condition:
1. It shall be unlawful during a level two condition outside of a fully enclosed permanent structure, camp trailer or mobile home, to build, maintain, attend or use a fire, campfire, charcoal broiler or grill producing an open flame.
2. It shall be unlawful during a level two condition to smoke outdoors in any area that is not entirely free of combustible materials for a three foot (3') radius from the person smoking.
3. It shall be unlawful during a level two condition to operate a two (2) cycle internal combustion engine which is not equipped with a USDA approved spark arrestor or fire mesh.
C. Level Three Condition:
1. It shall be unlawful during a level three condition outside of a fully enclosed permanent structure, camp trailer or mobile home, to build, maintain, attend or use a fire, campfire, charcoal broiler or grill producing an open flame.
2. It shall be unlawful during a level three condition outside of a fully enclosed permanent structure, camp trailer or mobile home, to build, maintain, attend or use any grill or stove producing an open flame using propane and petroleum fuels or coal or wood stove, or maintain any lighting device using propane or petroleum fuel.
3. It shall be unlawful during a level three condition to smoke except in a vehicle or fully enclosed building.
4. It shall be unlawful during a level three condition to operate a two (2) cycle internal combustion engine which is not equipped with a USDA approved spark arrestor or fire mesh.
D. Level Four Condition:
1. It shall be unlawful during a level four condition outside of a fully enclosed permanent structure, camp trailer or mobile home to build, maintain, attend or use a fire, campfire, charcoal broiler or grill producing an open flame.
2. It shall be unlawful during a level four condition outside of a fully enclosed permanent structure, camp trailer or mobile home, to build, maintain, attend or use any grill or stove producing an open flame using propane and petroleum fuels or coal or wood stove, or maintain any lighting device using propane or petroleum fuel.
3. It shall be unlawful during a level four condition to smoke except in a vehicle or fully enclosed building.
4. It shall be unlawful during a level four condition to operate a two (2) cycle internal combustion engine (e.g., chain saw, lawn mower, line trimmer, leaf blower). (Ord. 350, 5-12-2009)
