5-2-24: SNOWMOBILE OPERATION:
   A.   Definitions: As used in this section:
   DIRECT SUPERVISION: Having immediate physical and verbal control of the minor operating the snowmobile.
   OPERATOR: Any person who operates or is in actual physical control of a snowmobile.
   OWNER: Any person, other than a lienholder holding title by a bill of sale or other proof of ownership of a snowmobile or person having a leasehold interest in any snowmobile.
   SNOWMOBILE: Every motorized vehicle designed for operation on snow or ice, principally for recreational purposes, which uses sled type runners or skis and an endless belt tract, or a similar means of contact with the surface upon which it is operated, but does not include any farm implement or any military, law enforcement or emergency vehicle.
   B.   Operation Upon Streets:
      1.   Limited Areas: It shall be unlawful to operate a snowmobile on Burro Avenue between Glorietta Avenue and Swallow Place, in the village parks and on any street posted "no snowmobiles permitted".
      2.   Right Shoulder Of Road: Where permitted, snowmobiles must operate on the extreme right shoulder of the road in the direction of travel of the vehicle and in single file with other snowmobiles traveling in the same direction, and in such a manner as to not obstruct traffic; provided however, that such operation shall not be permitted on any road which is posted "no snowmobiles permitted".
   C.   Crossing Streets: Snowmobiles may cross streets and highways only if such crossing is made after coming to a complete stop prior to entering the roadway and after yielding the right of way to oncoming traffic, and only when such a crossing can be made in a safe manner and then only in the most direct manner as close to a perpendicular angle to the usual direction of traffic as possible.
   D.   Speed Limit: It shall be unlawful for any person to operate a snowmobile in excess of the posted speed limit any place within the corporate limits of the village.
   E.   Traffic Regulations Applicable: All traffic regulations contained in the motor vehicles and traffic title 1 of this code not inconsistent with the provisions of this section are hereby declared to be applicable to the operation of snowmobiles within the corporate limits of the village.
   F.   Yield Right Of Way: Operators of snowmobiles shall in all cases yield the right of way to all other vehicles and pedestrians.
   G.   Towing: It shall be unlawful to tow any object or persons with a snowmobile except a rigidly attached accessory specifically designed for towing by a snowmobile.
   H.   Licensing; Age Limit: Operators of snowmobiles shall be required to have a valid motor vehicle operator's license in their possession. Operators of snowmobiles shall be at least fifteen (15) years of age; provided, that any operator under the age of eighteen (18) must be directly supervised by an adult.
   I.   Renting: All persons who rent snowmobiles in the village which are intended to be operated in the village shall, prior to such rental, deliver a copy of this section to the person renting the machine.
   J.   Registration; Insurance Required: All snowmobiles operating in the corporate limits of the village must be registered in some state if required by the state where the owner resides and have liability insurance which meets the requirements for "motor vehicles" within the state.
   K.   Operation Regulations: No person shall operate a snowmobile:
      1.   In a careless or reckless manner so as to endanger the person or property of another, or to cause injury or damage to either, including a guest or passenger.
      2.   Without a lighted headlamp and a red or amber taillight that shall be lighted at all times during such operation.
      3.   Without a suitable braking device which may be operated by either hand or foot.
      4.   So that the exhaust of the motor makes an excessive or unusual noise or annoying smoke, except while participating in a sanctioned racing event.
      5.   In pursuit of any species of animal or bird protected by law.
      6.   During the hours of eleven o'clock (11:00) P.M. to seven o'clock (7:00) A.M. unless by special event permit.
      7.   On all state and federal highways except as allowed in subsection C of this section.
      8.   On private property without the permission of the owner or on sidewalks or posted areas.
   L.   Helmets: All operators or passengers under eighteen (18) years of age shall wear a safety helmet securely fastened to the head.
   M.   Parental Authorization: The parent or guardian of any child shall not authorize or knowingly permit any such child to violate any of the provisions of this section.
   N.   Rental Of Snowmobiles: No dealer or person who leases or rents snowmobiles shall lease or rent a snowmobile to a person unless the lessee or renter is in possession of a valid motor vehicle operator's license. If lessee or renter or any passenger is under the age of eighteen (18) the dealer shall provide a required safety helmet.
   O.   Misdemeanor For Violation: Every operator, owner or other person violating any provision of this section shall be deemed guilty of a misdemeanor and subject to penalty as provided in section 1-4-1 of this code. (Ord. 321, 1-13-2004)
