705.01 PUBLIC AUCTION DEFINED.
   "Public auction", as used in this chapter, means a sale or offering for sale to the highest bidder of any property, real or personal, in any building or in any public place, where any and all persons who choose to are permitted to attend and offer bids.

705.02 LICENSE REQUIRED.
   No person shall sell or offer for sale at public auction any property, real or personal, whether as the owner of such property or the agent or employee of another, unless such person has first obtained a license.

705.03 LICENSE APPLICATION AND BOND.
   Any person desiring to hold an auction sale shall file a sworn written application for a license, stating the name and the address of the applicant, the place where the sale is to be conducted, the name and address of the owner of the property proposed to be sold, and shall attach to it a sworn inventory and description thereof, and shall file with the Director of Finance a good and sufficient bond in the sum of five hundred dollars ($500.00) with two (2) or more sureties thereon, or with the surety thereon a surety company authorized to do business within the State of Ohio. The bond shall be subject to the approval of the Director of Law, and shall be conditioned upon the faithful observance of all the conditions of this chapter and the indemnity of any purchaser at such auction who suffers any loss by reason of any misrepresentation in such auction.

705.04 EXCEPTIONS.
   The provisions of this chapter shall not apply to an officer executing a process or order of any court having jurisdiction within the State of Ohio for selling property directed by law or court order or legal process to be sold at public auction; nor to licensed pawnbrokers selling or offering for sale unredeemed pledges in the manner provided by law; nor to municipal corporations, or subdivisions thereof or the Board of Education, to sell or offer for sale real or personal property at auction as provided by law; nor to the sale or offering for sale of personal property and chattels, encumbered by chattel mortgage or conditional sales agreement, the terms of which are in default.
