1345.09 RIGHT OF APPEAL; FEE.
   (a)   The owner, agent or operator of any structure or premises shall have the right to appeal to the Board of Zoning Appeals any order, written notice or determination by the Building Commissioner. Such appeal must be in writing and failure to file a written appeal with the appropriate Board as designated in the Codified Ordinances within thirty (30) days from the date such order, notice or determination was given, mailed or issued shall constitute a waiver of the right to appeal. Except in cases of emergency, as set forth in Section 1345.05, filing of an appeal from any such order, written notice or determination shall suspend enforcement proceedings until the appeal is acted upon by the Board.
   (b)   Each application or appeal to the Board of Zoning Appeals shall be accompanied by a fee of twenty-five dollars ($25.00), except that if such application or appeal shall require a public hearing, the fee shall be fifty dollars ($50.00).
