137.21 CONFLICT; DETERMINATION OF CONTROLLING PROVISION.
   If any provision of this chapter or any rule or regulation of the Civil Service Commission shall be in conflict with any provision contained in any labor agreement entered into by the City and a recognized employee labor organization relating to the compensation, hours, and terms and conditions of employment of City employees covered by such agreement, pursuant to Ohio R.C. Chapter 4117, and such conflict cannot be resolved by utilizing the rules of statutory construction, the provision of the agreement shall be deemed to be applicable and controlling unless the provision in the agreement is deemed to be contrary to law, in which case the provision of the chapter and the rules and regulations of the Civil Service Commission shall be deemed to be applicable and controlling.
