729.08 BOND.
   (a)   Bonds provided for in this article shall be so conditioned that the applicant shall comply fully with all of the provisions of this article or other ordinances of the City concerning the sale of goods, wares and merchandise and will pay all judgments rendered against such applicant for any violation of this article or other ordinance or statute, or any of them including all taxes due to the City or State, together with all judgements and costs that may be recovered against him by any person for damage growing out of any misrepresentation or deception practiced on any person transacting such business with the applicant, whether such misrepresentation or deceptions were made or practiced by the owner or their servants, agents or employees, either at the time of making the sale, or during the advertisements of any character whatsoever, printed or circulated with reference to the goods, wares and merchandise sold or any part thereof. Action on the bond may be brought in the name of the City to the use of the aggrieved person.
   (b)   In the event that no action is brought or claim made upon the bond within the time specified within the provisions of Sections 729.03 and 729.04 for the return of the cash bond or within ninety days from the date of cessation of business by any person, whichever period is shorter, the same shall be termed at an end and returned to the person giving the bond.
