729.03 ITINERANT VENDORS.
   (a)   Every itinerant vendor shall execute a continuing cash bond in the form prescribed by the Director of Finance, payable in cash or certified check, in the amount of two hundred fifty dollars ($250.00) payable to the City, conditioned that such itinerant vendor will pay all damages accruing to anyone by reason of any act or action done, performed or taken by such itinerant vendor in or about the conduct of his business and further conditioned that such itinerant vendor will pay all taxes, fees and penalties imposed by this City and the political subdivisions thereof; provided, however, that the aggregate liability of the cash bond for all such damages, taxes, fees and penalties shall, in no event, exceed the sum of such bond. Should any itinerant vendor fail to pay business and occupation taxes due and owing to the City within thirty days after the end of each quarter year, said cash bond shall automatically be forfeited unto the City as payment toward said taxes. If the Finance Director obtains information indicating that the amount of bond forfeited is not sufficient to cover the amount of taxes due, he shall issue a supplemental assessment of estimated tax mailed to the address shown on the license application.    Should the itinerant vendor (licensee) choose to terminate or not renew his license, said cash bond shall be refunded to the licensee within thirty days of payment of the respective quarterly business and occupation taxes. Should the itinerant vendor elect to renew his license by paying the requisite fee, upon payment of his quarterly business and occupation taxes, the Director of Finance may elect to hold and rollover said cash bond for the new license period.

   (b)   This bond shall be filed with the Director of Finance and shall be open to inspection during business hours to any person desiring to inspect the same.

   (c)   The license fee to carry on the business of itinerant vendor shall be one hundred dollars ($100.00) for Harrison County residents and businesses, and two hundred dollars ($200.00) for nonresidents of said County and business located outside of said County. The maximum duration for said license is one month for West Virginia residents and businesses, and fifteen days for nonresidents of said State and businesses located outside of said State.

   (d)   Every itinerant vendor who sells or exhibits for sale at public or private sale any goods, wares or merchandise without first obtaining a license therefor, and in all other respects complying with the provisions of this article, or who makes any false statement in reference to the matter set out in subsection (b) hereof, or who fails to comply with the requirements of any section of this article, and every person, whether principal or agent, who, by circular, handbill, newspaper, or in any manner advertises such sale, as herein described, before proper licenses are issued to the vendor, and before he has complied with the provisions of this article, is guilty of a violation of this article, and shall be punished in accordance with Section 711.99.
