729.04 HUCKSTERS, HAWKERS AND PEDDLERS; CANVASSERS AND SOLICITORS.
   (a)    Definitions.
      (1)    "City" means the City of Clarksburg, West Virginia.
      (2)    "Large Truck" means vehicles of Gross Vehicle Weight Rating, (GVWR) of eighteen thousand (18,000) pounds or greater and/or a length exceeding twenty (20) feet as, measured from the rear of the truck's cab to the end of the truck.
      (3)    "Small Pickup Truck" means a class I or class II truck or van of a GVWR of no more than ten thousand (10,000) pounds.
      (4)    "Large Pickup Truck" means a class III or IV truck or van of a GVWR of more than ten thousand (10,000) pound, but not more than seventeen thousand nine hundred and ninety-nine (17,999) pounds.
      (5)    "Trailer Truck" means a Class VIII truck with a GVWR exceeding thirty-three thousand (33,000) pounds that tow open or box trailer, which typically have three or more axels, including five (5) axel "Semi" or "18-wheeler" vehicles.
   (b)    No person without a City license therefor, shall act as a huckster, hawker or peddler within the City.
   (c)    The licensee fee to carry on the business of a huckster, hawker or peddler shall be twenty dollars ($20.00) per person for residents and businesses of Harrison County, West Virginia, and sixty dollars ($60.00) for residents and businesses located outside of said County, except for those non-Harrison County residents who sell goods and wares from large trucks as defined herein. The maximum duration for said license is thirty (30) days for sales from vehicles and sixty days for sales from door to door and on foot.

   (e)    The duration of such licenses shall be as follows:

   (f)    Should any huckster, hawker or peddler fail to pay business and occupation taxes due and owing to the City within thirty days after the end of each quarter year, said cash bond shall automatically be forfeited unto the City as payment toward said taxes. If the Director of Finance obtains information indicating that the amount of bond forfeited is not sufficient to cover the amount of taxes due, he shall issue a supplemental assessment of estimated tax mailed to the address as shown on the license application. Should the huckster, hawker or peddler (licensee) choose to terminate or not renew his license, said cash bond shall be refunded to the licensee within thirty days of payment of the respective quarterly business and occupation taxes. Should the huckster, hawker or peddler elect to renew his license by paying the requisite fee, upon payment of his quarterly business and occupation taxes, the Director of Finance may elect to hold and rollover said cash bond for the new license period.
   (g)    No person without a City license therefore, shall act as a canvasser or solicitor within the City. The license fee to carry on the business of a canvasser or solicitor shall be twenty-five dollars ($25.00) per person. The maximum duration for said license is thirty days for sales from vehicles and sixty days for sales door to door and on foot. Each canvasser or solicitor shall file with the Director of Finance a cash bond, payable in cash or certified check, in the penal sum of fifty dollars ($50.00). Should any canvasser or solicitor fail to pay business and occupation taxes due and owing to the City within thirty days after the end of each quarter year, said cash bond shall automatically be forfeited unto the City as payment of said taxes. If the Director of Finance obtains information indicating that the amount of bond forfeited is not sufficient to cover the amount of taxes due, he shall issue a supplemental assessment of estimated tax mailed to the address shown on the license application. Should the canvasser or solicitor (licensee) choose to terminate or not renew his license, said cash bond shall be refunded to the licensee within thirty days of payment of the respective quarterly business and occupation taxes. Should the canvasser or solicitor elect to renew his license by paying the requisite fee, upon payment of his quarterly business and occupation taxes, the Director of Finance may elect to hold and rollover said cash bond for new license period.
   (h)    No huckster, hawker or peddler, or canvasser or solicitor license shall be issued to any applicant where the proposed sales activity will occur on streets within the Central Business District of the City until the applicant obtains a street vendor permit from the City Manager's office as required under Section 541.11.
