2-74-030 Categories of positions in city service.
   All positions in the city service shall be in one of the following categories:
   (1)   Elected officials;
   (2)   Executive heads of city departments;
   (3)   Members of boards and commissions whose appointment is subject to confirmation by the city council;
   (4)   Senior executive service, consisting of positions which entail duties including city-wide or departmental level determinations of policy, or positions which entail the implementation of such policies, or positions requiring high technical or scientific skills, to be determined by the commissioner of human resources on the basis of quantitative job content evaluation, with the resultant listing published in the human resources rules. It shall include all positions listed in Appendix A, which is attached at the end of this chapter. The commissioner of human resources is authorized to add positions to the list of senior executive service employees and remove positions therefrom if: (a) the commissioner of human resources finds that the total job content as measured by the Hay Guide Chart – Profile Method (1980 Edition) of quantitative job content evaluations is 550 points or more for an added position or less than 550 points for a removed position; (b) the commissioner of human resources reports the finding in writing to the mayor; and (c) the mayor approves the finding in writing;
   (5)   Departmental employment service employees, consisting of the positions in the unskilled and semiskilled labor/trade and allied occupations, which positions are filled without city-wide competitive examinations, but subject to fair and valid job related pre-employment screening. The departmental employment service classes will be determined by the commissioner of human resources with the approval of the mayor on the basis of quantitative job content evaluation and the resultant listing published in the human resources rules. They shall include all positions listed in Appendix B, which is attached at the end of this chapter. The commissioner of human resources is authorized to add positions to the list of department employment service and remove them therefrom if: (a) the commissioner of human resources finds that a position is a labor/trades or allied occupational position having a job content under the Hay Guide Chart – Profile Method (1980 Edition) of quantitative Know How job content evaluation with 100 points or less for an added position or more than 100 points for a removed position; (b) the commissioner of human resources reports the finding in writing to the mayor; and (c) the mayor approves the finding in writing. Department employment service will also include all prevailing rate employees;
   (6)   Employees of the law department;
   (7)   Police officers above the rank of captain and firefighters above the rank of battalion chief;
   (8)   Employees whose work is seasonal and does not exceed 180 days in any calendar year;
   (9)   A private secretary for each elected official;
   (10)   Administrative assistants to the mayor, and such employees of the mayor's office as are appointed by the mayor;
   (11)   Employees of the city council, unless such positions are specifically included in the career service by ordinance;
   (12)   Positions exempted from the career service pursuant to the rule of the department upon recommendation of a department head and after comment and recommendation by the commissioner of human resources and the approval of the mayor. These additional exemptions must be based on the need for flexibility in appointment to positions which (a) are necessary in order to maintain confidentiality, or (b) are administratively necessary in order to effect a program including, but not limited to, such programs as student work experience programs, trainee programs, federal public service employment programs, and any other programs, which, because of the program requirements, cannot be subject to career service requirements;
   (13)   Career service employees, consisting of employees in all other positions and occupational classes other than in (1) through (12) above.
