§ 118.01 DEFINITIONS.
   For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   LICENSED ESTABLISHMENT. Any retail establishment which is licensed under the Liquor Control Ordinance of the village (Chapter 111), and where alcoholic liquor is drawn, poured, mixed, or otherwise served for consumption on the premises.
   LICENSED FRATERNAL ESTABLISHMENT. The location where a qualified fraternal organization that derives its charter from a national fraternal organization regularly meets.
   LICENSED VETERANS ESTABLISHMENT. The location where a qualified veterans organization that derives its charter from a national veterans organization regularly meets.
   VIDEO GAMING TERMINAL. Any electronic video game machine that, upon insertion of cash, is available to play or simulate the play of a video game, including but not limited to video poker, line up, and blackjack, as authorized by the Illinois Gaming Board utilizing a video display and microprocessors in which the player may receive free games or credits that can be redeemed for cash. The term does not include a machine that directly dispenses coins, cash or tokens or is for amusement purposes only.

§ 118.02 VIDEO GAMING PERMITTED.
   Notwithstanding any provision of any village ordinance heretofore adopted, including but not limited to § 111.35 of this Code of Ordinances, video gaming from video gaming terminals licensed by the State of Illinois and operated pursuant to the Video Gaming Act, 230 ILCS 40/1 et seq, is permitted in the village at licensed establishments, licensed fraternal establishments and licensed veterans establishments.

§ 118.03 PAYMENT OF VIDEO GAMING FEE.
   (A)   Each licensed establishment, licensed fraternal establishment and licensed veterans establishment within the village shall register each licensed machine annually utilizing forms provided by the Village Administrator, and in conjunction therewith, shall pay a fee of $250 per video gaming terminal per year to the village. The machines shall be registered and the fee shall be paid:
      (1)   Upon initial receipt of a license from the State of Illinois (prorated for the number of days remaining in the year from the initial date of licensure); and
      (2)   On or before January 15 of each year thereafter.
   (B)   Upon payment of the fee, the licensed establishment, licensed fraternal establishment or licensed veterans establishment shall provide the village with a copy of the establishment's current license from the State of Illinois.
   (C)   All fees collected pursuant to this section shall be used for enforcement of this chapter and monitoring compliance with the Video Gaming Act.
