ADOPTING ORDINANCE
ORDINANCE NO. 98-01
AN ORDINANCE ADOPTING A CODE OF ORDINANCES OF THE VILLAGE OF CHATHAM, ILLINOIS; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN; AND PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ORDINANCES.
   WHEREAS, pursuant to Section 1-2-3 of the Illinois Municipal Code, the Village President may appoint persons to revise the Village's ordinances, and the corporate authorities may enact an Ordinance adopting such revisions;
   WHEREAS, pursuant to Section 1-2-3 of the Illinois Municipal Code, the Village retained the services of American Legal Publishing to revise the Village's Ordinances, and American Legal Publishing Corporation, after consultation with the Village Board, has tendered to the Village a revised Code of Ordinances for the Village's adoption; and said Code is current through June 24, 1997;
   NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF CHATHAM, SANGAMON COUNTY, ILLINOIS, AS FOLLOWS:
   SECTION 1: The book of revised ordinances entitled "Village of Chatham Code of Ordinances" prepared by American Legal Publishing Corporation, is hereby adopted and enacted, and shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances passed by the President and Board of Trustees on or before June 24, 1997. Said book shall be known as the "Chatham Code of Ordinances".
   SECTION 2: All general ordinances of the Village of Chatham enacted prior to June 24, 1997, are hereby repealed, except such as are included in the Chatham Code of Ordinances or are by necessary implication reserved from repeal (subject to the saving clauses contained in the following sections), and excluding the following ordinances, which are not hereby repealed: tax levy ordinances; appropriation ordinances; ordinances relating to boundaries and annexations; franchise ordinances and other ordinances granting special rights to persons or corporations; contract ordinances and ordinances authorizing the execution of a contract or the issuance of warrants; salary ordinances; ordinances establishing, naming or vacating streets, alleys or other public places; improvement ordinances; bond ordinances; ordinances relating to elections; ordinances relating to the transfer or acceptance of real estate by or from the Village; and all special ordinances.
   SECTION 3: All general ordinances of the Village of Chatham passed after June 24, 1997 and before January 1, 1998, shall be incorporated into the Chatham Code of Ordinances, and the Clerk is authorized and directed to forward such ordinances to American Legal Publishing Corporation for incorporation therein in a revision to be published during 1998. Thereafter, all ordinances, when passed in such form as to indicate the intention of the President and Board of Trustees to make them a part of the Chatham Code of Ordinances, shall be deemed to be incorporated in such Code so that reference to the "Chatham Code of Ordinances" shall be understood and intended to include such additions and amendments.
   SECTION 4: A copy of the Chatham Code of Ordinances shall be kept on file in the Office of the Clerk, preserved in looseleaf form. It shall be the duty of the Clerk, or someone authorized by the Clerk, to insert in their designated places all amendments or ordinances which indicate the intention of the President and Board of Trustees to make the same a part of the Code when the same have been printed or reprinted in page form, and to extract from the Code all provisions which may from time to time be repealed by the President and Board of Trustees. This copy of the Chatham Code of Ordinances shall be available for all persons desiring to examine it and shall be considered the official Code of Ordinances of the Village of Chatham, Illinois.
   SECTION 5: The Chatham Code of Ordinances shall be in full force and effect, after its passage, approval and publication, on January 23, 1998.
   SECTION 6: This Ordinance and the Chatham Code of Ordinances shall be printed and published in book or pamphlet form by order of the President and Board of Trustees.
