A. Determining Acceptable Materials: Whenever the City or a special collector has in place one (1) or more recycling drop off facilities, persons who occupy or conduct business on the premises for which a recycling fee has been paid may bring to the drop off center those recyclable materials for which the City has provided a recycling receptacle. The MES Manager shall, from time to time, designate those recyclable materials which may be deposited at the drop off center.
B. Materials To Be Sorted: Persons who bring recyclable materials to the drop off center shall sort the recyclable materials and place them into the receptacle designed to receive each type of recyclable material. No recyclable material or any other material shall be left at the drop off facility on the ground, on top of drop off receptacles or outside the drop off facility.
C. Other Rules: The MES Manager may establish such other rules as are necessary for the clean, safe, healthy and efficient operation of recycling drop off facilities. Included in such rules may be provisions for how recyclable material deposited at the drop off facility shall be cleaned, prepared and sorted. (Ord. 2017-24)
A. Specific Dates Designated: At such dates as designated by the City Manager other than regular solid waste collection days, the presence of residential refuse and commercial refuse, including recyclable material and landscape waste, located at curbside will be notice to the City that a collection from that respective dwelling or property is desired. Once a collection has been completed, the owner or person in control of the property shall be responsible for charges imposed for the City designated solid waste collections.
B. Rates Set By Resolution: The owner and/or person in control of the property shall be responsible for charges imposed for the City designated solid waste collections and will be charged according to this chapter, at a rate set by resolution of the City Council of the City. (Ord. 2017-24)
A. Voluntary Extra Solid Waste Collections: Voluntary extra solid waste collections shall be available to buildings and/or premises qualifying for residential refuse collection only; all refuse shall be set curbside and shall conform to section 10-1-10 of this chapter.
1. Owners and/or persons wishing to schedule a voluntary extra solid waste collection shall notify the Office of the MES Manager in writing of their request by filling out an "extra solid waste pickup request" form. Upon receiving a properly filled out and signed form, the MES Manager will schedule a collection which shall be normally no later than two (2) working days after notification.
2. When the City provides voluntary extra solid waste collection services to a building and/or premises the fees for collection and disposing of said extra waste shall be as determined by resolution of the City Council and shall apply per minute or fractional minute of collection as rounded up to the next whole minute.
3. Said fees shall be added to and become a part of a water and/or sewer bill for the resident and/or property owner of record. (Ord. 2017-24)
A. Commercial Collection Service: Commercial collection (dumpster) service shall be available to commercial refuse customers as defined in section 10-1-1 of this chapter; no other entities, agencies, or properties shall be served.
1. The fees for commercial collection service shall be determined from time to time by resolution of the City Council. Fees shall be based on the number of containers and frequency of collection as desired by the customer; and shall be billed monthly as a part of the regular refuse/utility bill for the premises.
2. Commercial collection containers (dumpsters) shall be provided by the City and shall remain the property of the City; containers shall have a nominal capacity of two (2) cubic yards.
3. All refuse shall be properly placed into the provided containers (dumpsters) such that the lid can remain closed at all times. Any refuse or materials placed on top of or outside of the container shall result in extra fees being automatically imposed, said fees shall be as referenced in section 10-1-18 of this chapter. Any extra fees shall become a part of the refuse/utility bill for the business/premises.
4. It is the responsibility of the customer to keep the dumpster enclosures free of debris, litter, and other items. Should it become necessary for the City to pick up or remove debris, litter, and other items; extra fees will be imposed and distributed evenly to the customers utilizing the dumpster enclosure. Said fees shall be as referenced in section 10-1-18 of this chapter and shall become a part of the refuse/utility bill for the customers, businesses, and/or premises using the enclosure.
5. The MES Manager shall have the right to adjust frequency and/or number of containers should it become necessary to accommodate refuse volume(s) from specific customer(s). The MES Manager shall also have the right to determine and set other rules as deemed necessary for the clean, safe, healthy, and efficient operation of commercial collection services.
6. It is permissible for businesses that qualify for and utilize the City's commercial collection service to share a single container (dumpster); provided that the parties fill out the proper form and submit it to the MES Manager for approval. Said form shall designate all of the parties sharing the container(s) and shall clearly and equitably share the costs for service. The City is not responsible for and shall not divide or separately bill charges for shared container(s); the billing for shared container(s) shall be sent to the designated business or individual who will in turn be responsible for seeking reimbursement from the other parties. At no time shall any additional charges be imposed or passed on to the other parties who share the container(s). (Ord. 2017-24)
Any person violating any provisions of this chapter shall be subject to a fine not less than ten dollars ($10.00) nor more than seven hundred fifty dollars ($750.00). Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. (Ord. 2017-24)
