10-1-1: DEFINITIONS:
For the purpose of this chapter the following terms, phrases, words, and their derivation shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
   BUILDING: A structure used in whole or in part for human habitation, manufacturing, sales, and other purposes.
   CALLBACK FEE: A fee charged to a resident and/or property owner whose refuse and/or recycling was not placed at the curbside prior to seven o'clock (7:00) A.M. on the morning of their collection day; when, at the request of the customer, it becomes necessary for the collection truck(s) to make a return trip to collect said refuse and/or recycling from the premises or property. Callbacks can only be requested by the resident and/or property owner on their regular collection day.
   CARTS, SIZE: Roll-out carts are referenced herein in nominal sizes as readily available from various manufacturers; referenced cart sizes approximate and will vary on the manufacturer's specific standards and molds. Actual roll-out cart sizes/volumes will vary plus or minus three (±3) gallons.
   CITY: The City of Carbondale, Illinois.
   CITY COLLECTION STICKER: A placard sold by the City or agents of the City which may be affixed to an appropriate bag of landscape waste, tied bundle, or a special refuse item for the purpose of identifying prepayment for services rendered by the City for landscape and special waste collection services.
   CITY COUNCIL: The elected Governing Body of the City.
   CITY DESIGNATED SOLID WASTE COLLECTIONS: The collection of solid waste left at curbside within the City limits of Carbondale, Illinois, at specified dates designated by the City Manager. The collections will be operated by the City of Carbondale, in addition to regularly scheduled collections. Said collections shall be billed to the property owners of record and/or resident at rates set by resolution of the City Council.
   CITY REFUSE CUSTOMER: Any person who: a) selects the City as the designated collector of that person's building or premises which qualifies for residential refuse collection, or b) fails to select a designated collector other than the City within seven (7) days after occupying the person's building or premises which qualifies for residential refuse collection.
   COMMERCIAL REFUSE CUSTOMER (QUALIFICATIONS): City facilities and properties and businesses that utilize the City's dumpster enclosures located in City parking lots in the downtown area. No other agencies, properties or entities shall qualify as a commercial refuse customer. Any commercial customers currently being served by the City as of September 1, 2011, may continue their service with the City at a separate rate as determined by resolution of the City Council.
   CURBSIDE: A location on the public right-of-way in front of a particular building and/or premises where the owner and/or person occupying such property places their refuse or landscape waste for collection. Said location is normally between the curb or edge of street when no curb exists and the sidewalk or right-of- way line when no sidewalk exists. Should room not be sufficient between curb and sidewalk, refuse may be placed behind the sidewalk at a location approved by the MES Manager.
   DEMOLITION OR CONSTRUCTION DEBRIS: Refuse which is incidental to construction, renovation or demolition of buildings, other structures, or appurtenances on a premises.
   DESIGNATED COLLECTOR: The City or other licensed collector who has been selected by an owner and/or person to collect refuse, landscape waste, and/or recyclable materials from a building or premises.
   EXTRA VOLUME CHARGES: Charges that are automatically imposed should a qualifying residential refuse customer's volume exceed the capacity of the roll-out cart (95 gallons or 45 gallons) on their regular scheduled collection day. Residents being charged for a second cart will incur extra volume charges after they exceed the combined capacity of the two (2) carts. All items not contained completely within the cart or carts are subject to extra volume charges. These charges are set by resolution of the City Council and become a part of the regular bill for said refuse collection services.
   FINANCE DIRECTOR: The Director of the Department of Finance within the City of Carbondale, Illinois.
   GARBAGE: Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking, disposal and/or consumption of food. Cans, bottles, paper or plastic plates, plastic eating utensils, wrappings, etc., which contain or are soiled with putrescible animal or vegetable waste heretofore described shall be considered to be garbage. Dead animals or portions thereof shall also be considered as garbage.
   LANDSCAPE WASTE: Material comprised of leaves, yard waste, tree branches, and wood free of all other debris and/or refuse.
   LANDSCAPE WASTE COLLECTION: Landscape waste picked up from buildings and premises which qualify for residential and commercial refuse collection, but does not include demolition/construction debris.
   LEAF COLLECTION BAG: A commercially manufactured paper lawn waste bag with a capacity of not more than thirty (30) gallons.
   LEAVES: Yard waste resulting from deciduous and coniferous seasonal deposition.
   LICENSED COLLECTOR: Any person, firm or corporation whom the City has licensed for the collection, removal, and disposal of garbage or rubbish.
   MES MANAGER: The Manager of Maintenance and Environmental Services or his designee.
   OWNER: Any person or entity who shall have a legal, equitable or beneficial interest in the subject real estate, or any improvements thereto; or any type of leasehold interest in the subject real estate, or any improvements thereto; or a capacity to manage the subject real estate or any improvements thereto pursuant to an order of court, power, or agreement.
   PERSON: The owner, proprietor, occupant, or agent in charge of any building and/or premises.
   PREMISES: A parcel of land within the City of Carbondale including the adjoining street right-of-way or legal easement, separated from adjacent parcel of land by legal description.
   PUBLIC STREET: A street or roadway that permits unrestricted travel by the general public and that is maintained by a government entity; and/or a street or roadway that permits unrestricted travel by the general public that is privately maintained whereupon the City has written authorization from the owner(s), of said street or roadway, to operate its equipment and collect solid waste. At no time shall an alley or driveway be considered a public street. The MES Manager shall determine if a privately maintained street or roadway is adequate for the collection of solid waste and may require maintenance of the same by the private owner(s) for the safe and efficient operation of solid waste collection.
   RECYCLABLE MATERIAL: Newsprint and aluminum, glass, plastic and ferrous metal containers, for which there is in effect a recycling program operated by the City or pursuant to a franchise granted by the City to a special collector.
   REFUSE: Garbage and rubbish.
   RESIDENTIAL REFUSE COLLECTION (QUALIFICATIONS): The following buildings or premises qualify for residential refuse collection: single-family dwellings and duplex dwellings; triplex and fourplex dwellings may qualify only if all units contained in the building are signed up for refuse collection services; and limited small business establishments located in residential districts that generate ninety five (95) gallons (or up to 190 gallons if being charged for an extra cart) or less of refuse per week. All buildings or premises must have frontage on a public street to quality for residential refuse collection.
   RUBBISH: Nonputrescible solid waste consisting of both combustible and noncombustible wastes such as paper, wrappings, cigarettes, cardboard, tin cans, wood, glass, bedding, crockery, and similar materials.
   SOLID WASTE: All wastes, both putrescible and nonputrescible, combustible and noncombustible, except human body waste and including, but not limited to: garbage, refuse, recyclables, and landscape waste.
   SPECIAL COLLECTOR: Any person, firm, or corporation whom the City has granted a franchise for the collection, removal, and disposition of recyclable material.
   SPECIAL WASTE COLLECTION SERVICES: Collection of special wastes for recycling via a Prepayment Sticker Program. Special wastes include items such as: household appliances, water heaters, passenger and light truck tires, and other items as determined by the MES Manager.
   TIED BUNDLES: Items of rubbish or landscape waste such as lumber, tree branches, or wood stacked and secured by string or twine (not wire) into bundles not exceeding five feet (5') in length or twenty five (25) pounds in weight.
   TREE BRANCHES: Small tree limbs, brush cuttings, and other woody growth having a diameter of one-half inch (1/2"), but less than three inches (3").
   VACUUM LEAF COLLECTION (CURBSIDE LEAF VACUUM SERVICE): The collection of loose leaves from properties that qualify for residential refuse collection. Leaves must be raked to the curbside and conform to the guidelines as set by the MES Manager. Vacuum collection of loose leaves is requested via a call in scheduling basis, fees for this service are set by resolution of the City Council.
   VOLUNTARY EXTRA SOLID WASTE COLLECTION: Requests for collection of solid wastes by residents and/or owners of properties that qualify for residential refuse collection. Requests for this service shall be made in writing to the designated City division; fees for said service shall be as set by resolution of the City Council.
   WOOD: Tree limbs stripped of branches and trees having a diameter of three inches (3") and over up to twelve inches (12") inclusive. Construction and demolition debris and trees and limbs over twelve inches (12") are not included as wood.
   YARD WASTE: Grass clippings, lawn thatch, weeds, hedge clippings, garden waste, shredded tree branches, twigs no longer than two feet (2') in length and less than one-half inch (1/2") in diameter, and other such waste which can safely be placed into a yard waste bag without damaging the container.
