355.07 OUTSIDE PARKING OR STORAGE OF UNUSED MOTOR VEHICLES PROHIBITED.
   (a)    No person shall park, store, place or permit the parking, storing or placing of any abandoned junk motor vehicle or vehicle parts upon any private property in the City excepting:
      (1)    A vehicle with antique plates affixed thereto.
      (2)    A vehicle in a junk yard or scrap metal processing facility licensed under authority of the City.
      (3)    A vehicle being held for bona fide repairs on a repair order at an automobile service station or garage or body shop.
      (4)    A vehicle or vehicle parts in an enclosed building.
      (5)    A vehicle or vehicle parts stored on property owned by or under contract with the City permitting the storage of vehicles on such property.
   (b)   Upon notice that an abandoned junk motor vehicle or vehicle parts is in violation of subsection (a) hereof, a notice in writing shall be mailed or served upon the owner or occupant of the property where the abandoned junk motor vehicle or vehicle part is stored or in case there is no such occupant, then upon the owner of the vehicle or vehicle parts or his agent, requesting for removal of the abandoned junk motor vehicle or vehicle parts within ten days upon receipt of notice. In the event the foregoing persons cannot be found after reasonable effort and diligence, a notice may be posted in a conspicuous place on a building or on the abandoned junk motor vehicle or vehicle parts for a period of at least ten days.
   (c)   Upon notice as set forth in subsection (b) hereof, the owner or occupant of the property where the abandoned junk motor vehicle or vehicle parts is stored or the owner of the vehicle or vehicle parts, or his agent, either or all of them, shall be responsible in removing the abandoned junk motor vehicle or vehicle parts from the private property.
   (d)   The written notice shall be sent by the Health Department of the Municipality in all cases where a health hazard exists or may develop; otherwise, the Chief of Police or his designees shall send all notices required herein.
   (e)   In the event of removal, conveyance or towing of abandoned junk motor vehicle or vehicle parts, the owner or occupant of the private property where same is located and/or the owner of the abandoned junk motor vehicle or vehicle parts shall be liable for expenses incurred. Removal of junk motor vehicles or vehicle parts shall be performed by the Chief of Police upon request of the Health Commissioner or on his own initiative, and he shall take whatever enforcement action is necessary. The Chief shall designate a police officer(s) to enter upon private property to remove the abandoned junk motor vehicle or vehicle parts. It shall be unlawful for any person(s) to interfere with any police officer(s) so designated by the Chief to enter upon private property for the purpose of removing the abandoned junk motor vehicle or vehicle parts under the provisions contained herein.
