331.36 NOISY VEHICLES.
   (a)   Exhaust and Tire Noise. No person shall unnecessarily race the motor of any vehicle and no person shall operate any motor vehicle, except in an emergency, in such a manner that the vehicle is so rapidly accelerated or started from a stopped position that the exhaust system emits a loud, cracking or chattering noise unusual to its normal operation, or whereby the tires of such vehicle squeal or leave tire marks on the roadway commonly called “peeling”.
   (b)   Engine Brakes. No person shall use an Engine Brake, which is any device used on vehicles that changes the timing of the exhaust valves to slow the vehicle, within the City.
   (c)   Engine Retarders. No person shall use Engine Retarders including, but not limited to, such devices sold under the trade names of “C Brakes,” “Pac Brakes,” “Tek Brakes,” “Jake Brakes,” or any other type of Engine Retarder commonly utilized in the trucking industry, within the City.

   (d)   Penalty. Whoever violates this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
