The applicant for a conditional use permit to operate a Recreational Vehicle (RV) Park shall submit to the Board, prior to a public hearing, written evidence to assure that the following special criteria shall be complied with:
(a) Permitted uses. Recreational vehicle parks may include the following principal and accessory uses and structures, which shall be built to the Ohio Building Code, Ohio Fire Code and other relevant codes in the Canton Codified Ordinances, where applicable. The accessory uses and structures shall only be permitted in the presence of one or more principal uses or structures.
(1) Permitted principal uses and structures.
A. Recreational vehicles and improved (utilities, pads) or unimproved spaces.
B. Recreational vehicle parking and storage areas.
C. Recreation open space with recreational amenities.
(2) Permitted accessory uses and structures.
A. Park office.
B. A single park/camp store to supply retail goods for tenants and staff.
C. Sanitation-related structures, fixtures and amenities.
D. A limited, joint use maintenance structure and/or recreation hall.
(b) Occupancy. Occupancy of each individual Recreational Vehicle (RV) site/space is limited to one RV and not more than two passenger vehicles, accommodating one camping party. The length of stay in a RV park for each owner-occupied recreational vehicle (only) and/or its occupants is limited to a maximum of fifteen (15) consecutive days in any twelve (12)-month period. Moving to another space in the same recreational vehicle park does not reset the fifteen (15)-day clock.
(c) License.
(1) On or after the first day of April, but before the first day of May of each year, every person who intends to operate a RV park, shall procure a license to operate the park or camp from the licensor. An annual license fee is required to be paid to Canton City Public Health. The proceeds of this fee shall only be used for administering and enforcing Ohio Revised Code Chapter 3729, et seq. If the applicable license fee is not received by Canton City Public Health by the close of business on the last day of April, the applicant for the license shall pay a penalty equal to twenty-five per cent of the applicable license fee. The penalty shall accompany the license fee. If the last day of April is not a business day, the penalty attaches upon the close of business on the next business day.
(2) Before a license is initially issued under division (A) of this section and annually thereafter, or more often if necessary, Canton City Public Health shall cause each RV park to be inspected to determine compliance with this chapter and rules adopted under it. A record shall be made of each inspection on a form prescribed by the Director of Health.
(3) Each person applying for an initial license to operate a RV park shall provide acceptable proof to Canton City Public Health, that adequate fire protection will be provided and that applicable fire codes will be adhered to in the construction and operation of the park.
(d) Recreational Parks Design Standards.
(1) Recreational vehicle (RV) parks shall only be located in a B-4 Business District or PB-4 Planned Business District.
(2) Minimum park size: Five acres. The park must be on a single lot of record.
(3) RV parks shall only be located within 5,000 feet of an Interstate Highway on/off ramp.
(4) RV parks shall not be located within 2,000 feet of any school.
(5) Minimum park frontage/width: 200 feet. The tract of land shall consist of a single lot.
(6) Park minimum setbacks:
A. Front yard: thirty-five (35) feet.
B. Side yard: twenty-five (25) feet.
C. Rear yard: twenty-five (25) feet.
(7) RV site/space design standards.
A. Minimum site/space size: 500 square feet. A mix of sizes is suggested. No occupied recreational vehicle shall be located anywhere but in a recreational vehicle space and only one recreational vehicle shall be located within a single recreational vehicle space.
B. An RV shall be located at least thirty-five (35) feet from a public street or highway right-of-way and at least ten (25) feet from other property boundary lines.
C. Separation: Sites/spaces shall be designed so as to maintain a minimum of twenty (20) feet between recreational vehicles.
D. Parking: vehicle parking shall be provided in sufficient number to meet the needs of the occupants of the property and their guest without interference with normal movement of traffic. Each site/space shall include one parking space for one automobile. The parking space shall have dimensions in size compliant with Chapter 1184 of these regulations.
E. Each space shall be clearly marked, consecutively numbered or lettered with reflective three (3)-inch or four (4)-inch white numbers/letters on a blue sign.
(8) Utilities and lighting.
A. All utilities, including electrical power and telephone lines shall be installed underground.
B. Where a public water supply is available, it shall be used exclusively.
(9) Access and roads.
A. Each site/space shall have direct, unobstructed access to an internal RV park loop road, designed so as to permit the movement of recreational vehicles.
B. All interior recreational vehicle park roads shall be private roads, owned and maintained by the owner or operator of the recreational vehicle park. All roads shall be open for access at all times to the police department, other emergency and code enforcement personnel.
C. All roads shall be constructed in accordance with the provisions of the City of Canton subdivision regulations as amended.
D. Road minimum width requirements:
i. One-Way Streets: Twelve (12) feet One-Way Streets
ii. Two-Way Streets: Twenty (20) feet Two-Way Streets
(11) As a part of the approved site plan and any written development plans, an evergreen or comparable vegetation buffer shall be planted along all boundaries of the RV park, except that boundary abutting public Right-of-way. Existing natural buffers may be deemed appropriate.
(e) Miscellaneous Provisions.
(1) RV Parks are subject to all rules and regulations contained in this Chapter and Ohio Revised Code Chapter 3729, et seq., as applicable.
(2) The storage, collection and disposal of refuse in the park shall be managed as not to create health hazards. Garbage shall be collected and disposed of in a legal manner at least once per week.
(3) The conditional use permit issued by the Board of Zoning Appeals shall be revoked for:
A. Non-compliance with any of these regulations;
B. Serious or repeated violations of a requirement of these regulations;
C. Interference with the Zoning Inspector in performance of their duties.
D. Prior to revocation, the Zoning Inspector shall notify the conditional use permit holder or their designee, in writing, stating the reasons for which the permit is subject to revocation and advising that the permit shall be revoked at the end of ten (10) days following service of the notice.
