(a) Any person failing to comply with a notice of violation or order issued in pursuant to this Chapter shall be deemed liable for a civil infraction as follows:
(1) If a notice or order is not complied with within thirty (30) days, a Three Hundred Fifty Dollar ($350.00) fine will be assessed.
(2) If a second notice or order for the same violation within a one (1) year period is not complied with within thirty (30) days, a Five Hundred Dollar ($500.00) fine will be assessed.
(b) If a third notice or order for the same violation within a one (1) year period is not complied with within thirty (30) days of the notice, the violator will be charged with a first degree misdemeanor.

(c) The time restraints may be modified by the Chief Building Official or designee due to inclement weather or type of violation.
