(a) In accordance with Canton Codified Ordinances Chapter 1371, the City of Canton shall have the authority and the duty to inspect non-residential properties subject to this Chapter for compliance and to issue citations for any violations of the City Building Code.
(b) The Chief Building Official or designee shall make all of the required inspections, or shall accept reports of inspection by approved agencies or individuals. All reports of such inspections shall be in writing and be certified by a responsible individual. The Chief Building Official or designee is authorized to engage such expert opinion as deemed necessary to report upon unusual technical issues that arise, subject to the approval of the appointing authority.
(1) Exterior inspections of vacant non-residential property shall be conducted upon each registration of the non-residential property pursuant to this Chapter.
(2) Interior inspections or reinspections shall be conducted upon the following occurrences, either with the consent of the owner or authorized agent, or pursuant to a search warrant obtained under Canton Codified Ordinance Section 1301.20:
A. The issuance of a notice of violation of the City Building Code following an exterior inspection, which is not resolved or corrected by the property owner.
B. Whether upon the receipt of a complaint or otherwise, the Chief Building Official or designee determines that probable cause exists to believe that a serious hazard is present within the nonresidential property.
C. Following the issuance of a notice of violation of the Canton Building Code following an interior inspection, which is not resolved or corrected by the property owner.
(c) The owner of a non-residential property which requires an interior inspection pursuant to subsection (b)(2) hereof shall pay a fee to cover the costs of the interior inspection and related administrative costs as follows:
(1) For a building structure 5,000 square feet or less: $250
(2) For a building structure greater than 5,000 square feet to 10,000 square feet: $500
(3) For a building structure greater than 10,000 square feet to 25,000 square feet: $1000
(4) For a building structure greater than 25,000 square feet: $2000.
