(a) Any person, firm or corporation against whom an order is served, to include a notice of violation, citation or revocation, suspension or denial of the issuance of a license or permit pursuant to this Fire Prevention Code, may within five days of the service of such order appeal to the Fire Chief in writing. The Fire Chief shall, within five days of receipt of the appeal, review such order and shall issue a decision affirming, vacating or modifying the order appealed from.
(b) The decision of the Fire Chief may be further appealed to the Director of Public Service/Safety by filing a written notice of appeal within ten days from date of the Fire Chief's decision. The Director shall conduct a hearing when requested and shall within seven days of the hearing issue a decision affirming, vacating or modifying the decision of the Fire Chief.
(c) Any decision concerning the revocation, suspension or denial of a license may thereafter be appealed to the City License Appeals Board pursuant to the provisions of Chapter 149 of the Codified Ordinances of the City. Any other decision of the Director concerning any order issued pursuant to this Code may be appealed in the manner required by law.
(d) The filing of any appeal under this section shall not suspend any order appealed from or relieve the person against whom any order is issued from immediate compliance with the order when there is actual or potential danger to any occupants or any person in the proximity of any building, structure or premises because of unsafe structural conditions, inadequacy of any means of egress, the presence of explosives, explosive fumes or vapors, the presence of toxic fumes, gases or materials, or any other dangerous condition in the opinion of the Fire Prevention Bureau, which requires the immediate evacuation of such building, structure or premises.
