1501.01 ADOPTION OF BOCA NATIONAL FIRE PREVENTION CODE; OHIO FIRE CODE.
   (a)   The City of Canton approves and adopts the BOCA National Fire Prevention Code/ 1987, 7th Edition, hereinafter referred to as "BOCA", and any additions or amendments as may be hereafter promulgated, as the Fire Prevention Code of the City. Each and all of the provisions of BOCA are hereby adopted and made a part hereof as if fully set out in this chapter, with the exception of the following provisions of BOCA, which are deleted:
      (1)    Section F-104.0, Means of Appeals;
      (2)    Section F-405.0, Elevator Recall; and
      (3)    Article 27, Fireworks.
   (b)   The City shall, in addition to and in supplementation of BOCA, utilize and enforce the Ohio Fire Code, which is promulgated by the State Fire Marshal. The Chief of the Fire Prevention Bureau may, with the approval of the Fire Chief, make inspections, write violations and institute enforcement proceedings pursuant either to BOCA or the Ohio Fire Code.
   (c)   Nothing in BOCA shall be construed, interpreted or applied to abrogate, nullify or abolish any law, ordinance or code adopted by the City or the State of Ohio governing the construction, alteration, addition, repair, removal, demolition, use, location, occupancy and maintenance of buildings specifically provided herein. When any provision of BOCA is found to be in conflict with any building, zoning, safety, health or other applicable law, ordinance or code of the City or State of Ohio, the provision which establishes the higher standard for the promotion and protection of the safety and welfare of the public shall prevail.
